Case Summary – The Yamuna Expressway

 In the year 1997, Ms. Mayawati the then Chief Minister of Utter Pradesh
conceived Yamuna Expressway(YE) as a dream project with a vision of reducing
the travel time between Delhi and Agra.
 The project will also open gates for industrial and urban development of the
region. The expressway will reduce the travel time up to 100 minutes with a speed
limit of 120 km/hr.
 On April 24th 2001, GoUP formulated Taj Expressway Authority with the
responsibility of executing the Taj Expressway project, acquisition of land,
preparation of development plans and other associated facilities along the
expressway which passes through 334 villages in different districts of Uttar
Pradesh.
 In August 2001, global tender inviting bid were issued but due to non-availability
of eligible bidders fresh bids were invited in November 2002.
 On January 28th 2003, (Jaiprakash Associate Limited)JAL was selected for the
execution of the project as they claimed lowest concession period of 36 months.
The project revenue model included tolling in development of 2500 hectare of
townships.
 MoU was signed on January 31st 2003 and the concession agreement was signed
on February 7, 2003 which was to be developed in 3 phases with the construction
period of 7 years.
 With the change in the government, allegations of were charged against the
previous government that they didn’t follow the legal procedures in the process
and also didn’t obtain performance guarantee from JAL.
 On October 12 2006, Narayan Committee cleared all the allegations made by the
then government and recommended the State Pollution Control Board to expedite
the process of granting EC and also recommended the speedy recommended of
the process.
 In April 2007, the project restarted and on July 2008, the name of the project was
changed from TE to YE
 The land compensation in Mathura was increased from Rs. 350/sqm to Rs.
388/sqm owing to agitation of the farmers. On February 20, 2009, MG issues a
notice to acquire 1604 hectares of land under urgency clause against which a PIL
was filed in SC. On September 8th, 2010, the judgment was ruled in favor of the
government.
 JIL went public on May 21st 2010 and raised Rs. 2250 Cr through IPO.
 On August 6th, 2010 SC questioned the environment clearance given in the 60km
vicinity of Taj Mahal to which YEIDA and JIL replied that they had sought
permission for everything and environment impact assessment had already been
done.
 In August 2010, some farmers in Tappal village constituted Sarvadal Kisan
Sangharsh Samiti and held a demonstration in Mathura under leadership of Samiti
president Mr. Ram Babu Katariaon August 14, 2010. Violence broke out and 3
farmers and one officer lost their life. Compensation of Rs 10 lakh was announced
from the side of government for the families of the deceased and compensation
price was raised from Rs. 436/sqm to Rs. 570/sqm.
 Farmers were instigated by the local political parties and demanded unreasonable
amount as compensation, hence the Government decided to cancel the project.
Farmers were helpless against the government’s decision to cancel the project as
the compensation amount was already committed elsewhere and they couldn’t
repay the amount to government. So they conveyed the DM Mr. K Ravindra
Nayar that they weren’t against this project. After this, the GoUP revived the
project.
 On October 20 2010, the GoUP made it compulsory to plant trees along the
expressway.

Epilogue:

 The project was inaugurated on 9th august 2012 via then CM of Uttar
Pradesh Mr. Akhilesh Yadav through video conferencing.
 The earning of the JP group from the toll collection as of march 31st 2015
was just 200 Cr against the predicted value of 1000 Cr.
 The Yamuna expressway became the first road landing expressway in
India to land an IAF fighter jet “The French-made Dassault Mirage 2000”
on 21st May, 2015
