RELIEF SOUGHT:
1. Pass a writ of Mandamus or any other writ, order or direction of appropriate
nature, to grant an opportunity to the petitioner for verification of documents and
consider his case before declaring the final results.
BRIEF FACTS:
● Present Writ Petition filed under Article 226 of the Constitution of India.
● The respondent vide the Notification dated 03.03.2018, refer Annexure-A, invited the
application for the post of Sub- In spector in Delhi Police, CAPFs and Assistant Sub-
Inspectors in ClSF. The petitioner is one such applicant, who qualifies as per the
qualification criteria set by the respondent and has thus applied for the post.
● The Staff Selection Commission conducted Examination in four stages i.e. Paper
I(Copy Result in Annexure A-2), Physical Endurance Test/ Physical Standard
Test(Copy Result in Annexure A-3), Paper II(Copy Result in Annexure A-4) and
lastly the medical Examination(Copy Result in Annexure A-6).
● The petitioner has qualified all the stages as per the cut off prescribed by the
respondent without default.
● [10.09.2020,] The medical examination for the petitioner was to take place, for which
a call letter was sent (Annexure A-5), the same was intimated via text message by the
Regional Network of the Staff Selection Commission.
● [08.02.2021]The result of the medical examination is declared, and the petitioner
qualifies for appearing before the Commission for getting his documents verified.
● [25.02.2021] The Northern Region Office of the Staff Selection Commission declares
the date for document verification to be held between 08.03.21 and 13.03.21.
● Since the petitioner was not made aware of the aforementioned dates of examination
by way of text message/e-mail and also as he was discharging his duties, cast upon
him by virtue of holding such posts, as Naib in the Tis Hazari District Court.
● The workload of the Petitioner as the Naib in the Tis Hazari District Court, has
increased because of the reduced capacity of the workforce at the workplace of the
Petitioner, and also the fact that sometimes the petitioner was assigned the
unscheduled duties at odd hours, due to which the Petitioner hadn't had much time to
visit the site of the Respondent and check any notice with respect to the Document
Verification.
● [31.03.21] The petitioner via mail message(Annexure A-7) requests for another
chance for document verification but no reply from the respondent. The same is
repeated on l0.04.2021 (Annexure A-8), where again, the respondent didn’t reply.
● [24.07.2020] And results of which, this petition is presented.
