SECTION 3. CONDITIONS OF SERVICE
(1) It talks about organizations having its own service rules but the rules
should not be less favorable to any worker. The service rule should be
more than the labor law and it cannot violate the labor law
(2) The service rules will be submitted to the Chief Inspector for approval
and the Chief Inspector will approve the service rule within 90 days or 3
months.
(3) Without the approval of the chief inspector, service rules cannot be
applied within the organization.
(4) If organization is not satisfied with the decision of the chief inspection,
organization can appeal within 30 days and within 45 days chief inspector
will take the final decision.
(5) This condition will not be applicable for any organizations owned or
managed by the government.
SECTION 4. CLASSIFICATION OF
WORKERS AND PROBATION PERIOD.
(2) The employer can issue an order of leave within 7 (seven) days of receiving the leave
application or issue can be given 2 (two) days before the leave, it depends on when employee is
applying for leave. whichever is earlier:
However, if due to any urgent leave applied, approval can be given on the date of application or
within 3 (three) days before the leave.
3) If the leave asked for is granted, a leave pass shall be issued to the worker. Not for employees.
For employees, a letter is given.
(4) If the leave asked is refused or suspended, the refusal and the reasons will be communicated
to the worker/employee before the date on which they applied for a leave, and it will also be
recorded in the register maintained for the purpose.
(5) If any worker, after he went on leave, desires an extension he have to apply for leave extension
before the leave ends. 1[in writing by registered post before reasonable time] of the expiry of
the leave to the employer who shall send a written reply either of granting or of refusing the
extension of leave to the worker to his leave-address.
SECTION 12. STOPPAGE OF WORK.
(1) In case of any incident such as fire breakout, sudden
catastrophe, broken machinery, stoppage of power supply,
widespread riots or any other cause beyond his control,
cause for such stoppage of work that continues to exist.
(2) During this time, they will get half amount of their basic
salary and full amount of housing facility.
SECTION19. COMPENSATION FOR DEATH
In case If a worker dies of natural cause or accidentally and
if that worker completed at least more than 02 (two) years
in an organization, then the organization will pay 30
(thirty) days wages as compensation. If a worker dies while
working in the organization or an accidental death while
working in the organization, then the organization will pay
45 (forty five) days wages for every competed year of his
service.
or any part thereof exceeding 6 (six) months or gratuity,
whichever is higher, to the nominee of the deceased
worker or, in the absence of the nominee, to his
dependent and this money shall be in addition to the
retirement benefit to which the deceased worker
would have been entitled had he retired from service.]
SECTION 20. RETRENCHMENT
(REMOVING SURPLUS WORKERS).
(b) send a copy of the notice to the Chief Inspector or any other
officer specified by him, and another copy to the collective
bargaining agent of the establishment, if any; and
(c) pay him as compensation 30 (thirty) days’ wages for his every
year of service or gratuity, if any, whichever is higher.
SECTION 23. PUNISHMENT FOR
MISCONDUCT AND CONVICTION
(1) A worker can be dismissed without a notice or without providing any
wages instead of a notice if they have committed any criminal offence; or
found guilty of misconduct.
(2) Also, if found guilty of misconduct instead of being dismissed workers can get
punishments such as removal, demotion, stoppage of promotion for 1 (one) year, fine,
suspension without wages, censure and warning.
(2) A worker charged for misconduct can also be suspended and the
suspension period will not be more than 60 (sixty) days:
during suspension, a worker will be paid allowance and he shall get
other allowances in full.
