Critical analysis and review of the research project
The author, Avisha Dhiman, enrollment number 2021 140, has made her Torts research project
on the topic- Environmental Torts
In her project on the above mentioned topic, the author has introduced the topic of her project by
shedding some light on how torts law is associated with civil wrongs and also underlined the
basic principle of tort law. The relation between Indian tort law and English law has also been
discussed and how Indian tort law differs from the English law has been described.
The author has discussed how tort law is better suited for environmental harm cases than
litigation. The differentiation on how tort law is different and better than legislations and statutes
is made by focusing on both harm and risks, and also the aspect of compensation in tort law is
focused upon.
The problems and challenges faced in such cases of environmental tort, and how environmental
statutes come into place in such scenarios have also been discussed by the author. And also the
advantages of tort law for environmental pollution cases are talked upon in the research paper.
Environmental cases have majorly been classified into 4 categories under tort law by the author
in the research project, and are described with case laws and various judgments in a very lucid
language. The categories are defined in layman’s terms and legal language both, making it easy
to understand for a reader from a non-legal background, and also making it more informative and
insightful for a person from a legal background. Various examples are also given by citing cases
relating to the respective category to explain it better and make it more informative.
The author has also talked about how any different rationale is considered in environmental law
than any other tort law. How the court judged various cases relating to environmental issues is
also described by giving the difference in the rationale and the scenario.
Every category is first defined in general tort law, and then specifically discussed in context of
environmental issues explaining about how the rationale behind that tort law is applied in
environmental cases. What are the various possible problems and challenges faced under
environmental cases in every category are discussed and explained very well with examples.
The various defences that can be used under every category are also described in layman’s terms.
The research project made by the author is very informative and also easy to understand for even
a layman who does not have any legal knowledge.
The author has concluded her project by talking about how statutes, legislations and tort law can
exist together to curb environmental harm in a better way and also has given her own insight
about the issue.
The author has made a genuine effort to gather various landmark cases, verified information
which shows that the author has done extensive research to make her project very informative
and upto the mark. The sources cited by the author for the research project are genuine and are
verified sources of information. The project has both facts and the author's own insight and
viewpoint about the topic. In my opinion, considering the fact that this is the first legal research
paper written by the author, the paper is of above average standard, which can be read and
understood by readers from any academic background. It provides good and insightful
information on the topic of Environmental torts.
