Unit I
Introduction to Intellectual Property Rights: Concept of property, Nature and types of intellectual property,
Constitutional aspects of IPR, Conventions and treaties, Commercial exploitation of intellectual property, Intellectual
property and economic development, Enforcement of rights and remedies against infringement, International
character of intellectual property.
Unit II
Patents: Meaning of patent and its purpose, Object of patent law, Evolution of patent system, Application for patent,
Criteria for patentability, Non – patentable inventions, Provisional and complete specification, Publication of the
application, Opposition to grant of patent, Grant of patent – priority date, date of patent, date of sealing, Term of
patent.
Unit III
Rights and Obligations of Patent Holder: Rights of patent holder - monopoly, assignment, licence, Working of
patent and compulsory licence, Obligations of patent holder, Types of patents, Infringement of patents – suits,
defence, reliefs, Patent agents – qualifications and responsibilities, Industrial design - registration, rights,
infringement and remedies.

Trade Marks: Features and classification, Rights conferred by registration of trade mark, Marks not registrable,
Application and procedure for registration of trademarks - term and renewal, Assignment of trade mark, Infringement

trademarks, service mark, collective mark.
Unit V
Copy Right: Evolution of copy right law, Meaning, content and substance of copy right, Ownership, rights and period
of copyright, Assignment of copyright and relinquishment, Licence and compulsory licences, Registrar of copyright
and copyright board, Application for registration, Infringement, remedies, offences and penalties, defences against
infringement. Fair use.

1. have an understanding of the fundamental legal principles relating to confidential information, copyright,
patents, designs, trademarks and unfair competition;
2. be able to identify, apply and assess principles of law relating to each of these areas of intellectual property;
3. understand the legal and practical steps needed to ensure that intellectual property rights remain valid and
enforceable;
4. be able to demonstrate a capacity to identify, apply and assess ownership rights and marketing protection
under intellectual property law as applicable to information, ideas, new products and product marketing;
5. understand current and emerging issues relating to the intellectual property protection, including those
relating to indigenous knowledge or culture, information technology especially the distribution of material on
the internet, biotechnology and international trade; and
6. be able to anticipate and subject to critical analysis arguments relating to the development and reform of
intellectual property right institutions and their likely impact on creativity and innovation.
