‘Thank you for writing to Newberry Township with your request for information
prsuant tothe Pennsylvania Right-To-Know Law (the “Law”).
(On 12/24/2020, you requested the Township to provide the following;
“Please provide the job applications and resumes for the following Township
employees, along with the job descriptions to which each applied to:
‘Tony Miller, Township Manager
Jane Deamet, Comptroller
Gayle Russell, Sewer Administrator
Laura Kauffinan, Office Assistant”
Section 302 of the Law obligates the Township to “provide public records in
svcordance withthe [Law]". Section 102 ofthe Law defines a “record” as the following:
Information, regardless of physical form or characteristis, that documents
‘transaction or activity ofan agency and tat i created, received or retained
pursuant to law or in connection with transaction, business or activity of |
the agency. ‘The term [record] includes @ document, paper, letter, map,
book, tape, photograph, film or sound recording, information slored or
‘maintained electronically and a data-processed or image-process document.
‘The Township has granted your request for the resume’s and job descriptions to
‘which they applied. See attached documents,
‘The township has denied your other request for job applications as no record(s)Page 2
‘You have aright to appeal this denial in writing to: Office of Open Reeords, 333
