COURTS DISCRETION

▣ Sec. 20 of Specific Relief Act state that the courts


have the discretionary power on granting the relief
of Specific Performance.
▣ The court is not bound to grant such relief.
▣ But it should sound reasonable, guided by judicial
principles.
▣ Appeal is allowed.
Court may not grant the decree of
specific performance when:

▣ Contract give unfair advantage to plaintiff.


▣ When it create hardship to the defendant.
▣ Unjust contracts.
