2.5 All Orders will be deemed to be irrevocable Article 18


Seller who offers goods and/or service that intended for being
traded is prohibited from making or including standard clauses
in every document/ agreement if:

guarantees) if the total price for the Product has not been paid in agreed warranty and/or guarantee

PROPOSED SOLUTION (A)
Q : Are these articles in compliance with Consumer Protection Law of Indonesia?

A : No, because it is bending The Consumer Protection Law No.8 of 1999.

Clause to be modified:

2.5 There should be a clear policy regarding cancellation of order which are well-informed to
all of the parties

2.6 Removing the “Seller’s discretion” as the basis of order processing in to something more
tangible in the form of clear policy

2.8 A more comprehensive restitution to incorporate consumer’s material loss

2.11(6) Warranty will void only because of the validity period and not based on the full
payment
PROPOSED SOLUTION (B)
Q : If a customer disputes the sales conducted through Lazada, what are the options for the
customer to resolve this dispute?
A : Make risk mitigation

Lazada:

- Make education routinely regarding term and condition before buy the product.
- Mediate the disputes between Lazada, Seller & Consumers

Customer:

- Raise the disputes to customer services of Lazada.


- Bring documentation of transaction, terms and conditions, and others related to the dispute.
- If there is no solution in the mediation conducted by Lazada, raise to YLKI.
Based on The Consumer Protection Law No.8 of 1999 article 19 Buyers can make claims against
Lazada which are not only related to compensation as stated in clauses (1) and (2) but can also file
criminal charges based on further evidence as stated in clauses (2)
