PETITION
Petitioner, MARIA FLORENCE N. BAYLAR, respectfully appears before this
Honorable Court and alleges, THAT:

1. She is a Filipino, of legal age, widow, and a resident of 2 South Tower, Pasig City,
Metro Manila, Philippines;

2. She is the niece-in-law of the testator, AMELIA CANTAR BAYLAR (“Ms.


BAYLAR”), who died single and without issue on February 27, 1947. At the time
of her death, she was a resident of SURIGAO City, Philippines. A copy of Ms.
BAYLAR’s death certificate is hereto attached as Annex “A” to form an integral
part hereof;

3. On March 1, 1937, Ms. BAYLAR executed a Holographic Last Will and


Testament, a copy of which is hereto attached as Annex “B” to form an integral
part hereof;

4. To execute the provisions of her last will and testament, Ms. BAYLAR named
Petitioner as executor to serve without bond;

5. Upon her death, Ms. BAYLAR owned a house and lot located at Providence
Village, Surigao City and a parcel of land located at Magellan City, Cebu with a
combined probable value of Ten Thousand Pesos (P10,000.00); and

6. Petitioner does not know of any outstanding indebtedness that the late Ms.
BAYLAR left when she died.

PRAYER
Imbued with gratitude for the trust reposed on her by her late aunt-in-law, Petitioner
prays that after due notice and hearing, the Honorable Court pass in probate the said
last will and testament of the late AMELIA CANTAR BAYLAR and designate as
executor thereof Petitioner in accordance with the said last will and testament, without
bond, who will proceed to execute the same.
Other reliefs and remedies just and equitable in the premises are likewise prayed for
before this Honorable Court.

I, MARIA FLORENCE N. BAYLAR, of legal age, widow, Filipino, and a resident of 2 South Tower,
Pasig City, Metro Manila, Philippines, after having been duly sworn to in accordance with law, depose
and state that:

1. I caused the preparation of the foregoing Petition for Probate of the Last Will and Testament of the
late AMELIA CANTAR BAYLAR.

2. I have read and understood its contents which are true and correct of my personal knowledge, or
based on authentic document.

3. The pleading is not filed to harass, cause unnecessary delay, or needlessly increase the cost of
litigation.

4. The factual allegations therein have evidentiary support or, if specifically so identified, will likewise
have evidentiary support after a reasonable opportunity for discovery.

5. I have not theretofore commenced any action or filed any claim involving the same issues in any
court, tribunal or quasi-judicial agency and, to the best of my knowledge, no such other action or
claim is pending therein.

6. If I should thereafter learn that the same or similar action or claim has been filed or is pending, I shall
report that fact within five (5) calendar days therefrom to the court wherein aforesaid complaint or
initiatory pleading has been filed.
