ON RESTRICTIONS:
Under RA No. 730, it was amended by PD No. 2004,
dated December 30, 1985, amended Sec. 2 of RA No.
730.
Sec. 2. Lands acquired under the provisions of
this Act shall not be subject to any restrictions
against encumbrance of alienation before and
after the issuance of the patents thereon.

So long as this particular act is in effect, there are no


more restrictions against any encumbrance or alien-
ation ONLY FOR MSAs UNDER RA 730. Restrictions
would still apply for patents which were discussed un-
der CA 141.

In all of these patents, JUST TAKE NOTE that these


are being issued by virtue of the State’s liberality. The
concept revolves around this concept because it ex-
plains why we have requirements, why it is construed
against the applicant and in favor of the State, because
it is given by way of the State’s generosity.

Because the policy of the government is to promote so-


cial equity through public land distribution which is why
we have these modes of disposition of public lands.
