LEGAL STATUS: Married
OCCUPATION: Government Employee

This Judicial Affidavit of Mr. Jose Castillo is being offered

to prove the material allegations in the complaint for Unlawful
Detainer against the Defendants spouses Juan and Estella
Bernabe to provide additional and/or testimony regarding the
matter of the case at hand, to identify the documents and
other evidence pertinent to the above case.

The examination of the witness was conducted and

supervised by Atty. Arman D. Alipit Jr. at his office at Block
001, Asuncion Building, Bauan, Batangas.

The question were prompted in English which the
witness understands, while the answers were given by him in
Filipino dialect but corresponding translation thereof is
provided after each question.

1. Q: How are you related to Susan Roxas, the plaintiff in

Civil Case 3657 before the MCTC of Taal-San Nicholas for
Unlawful Detainer with damages against spouses Juan
and Estella Bernabe?

A: We are not related with each other sir.

2. Q: How did you know the plaintiff Susan Roxas?

A: Susan Roxas is the buyer of our 500 square meter

parcel of lot located at Brgy. Butong, Taal, Batangas.

3. Q: Do you know the defendant spouses Juan and

Estella Bernabe?

A: Yes, sir. They are occupying some portion of the

subject lot that was sold to Susan Roxas.

4. Q: How did the spouses Juan and Estella Bernabe

occupy the portion of the subject lot?

A: They were allowed to occupy the subject lot by our

consent or tolerance.

5. Q: When did you sold the subject lot to Susan Roxas?

A: The subject lot was sold to Susan Roxas on March

14, 2012.

6. Q: I am showing you a certified true copy of a Deed of

Sale, can you recall if this the Deed of Sale that you
executed in favor of Susan Roxas?

A: Yes, sir. That is the Deed of Sale that we executed during

the sale.

7. Q: Where did you execute the Deed of Sale?

A: We executed the Deed of Sale at our residence

located at Brgy. Butong, Taal, Batangas.

8. Q: Did Susan Roxas know the occupation of spouses

Juan and Estella Bernabe on the subject lot?

A: Yes, sir. Susan Roxas was aware of the occupation

of the spouses Juan and Estella Bernabe on the subject
lot.

9. Q: What did Susan Roxas do upon knowing the

occupation of the defendant spouses Juan and Estella
Bernabe on the the subject lot?

A: Susan Roxas also tolerated the occupation of the

spouses Juan and Estella Bernabe on the subject lot.

10. Q: Do you affirm the truthfulness and veracity of this

Judicial Affidavit?

A: Yes, Sir.

11. Q: Do you answer these questions fully conscious that

you do so under oath and that you may be criminally
held liable for false testimony or perjury?

A: Yes, sir.
