JUDICIAL AFFIDAVIT OF WITNESS

Petitioner, thru counsel, and unto this Honorable Court, respectfully

submits the Judicial Affidavit of Witness for the Petitioner, to wit:

That I am, JUANA DELA CRUZ, Filipino, married and a resident of

Brgy. Pula, Tagudin, Ilocos Sur, swear to the truthfulness of my testimony
and I know that I will face criminal liability for false testimony or perjury,
hereby depose and say, that:

ATTY. SANDRA M. AGOOT: We are offering the testimony of witness

to prove, that:

1. She is the mother of Marilou De Guzman out of wedlock and that

the petitioner was known in their community as Marilou Dela
Cruz and had been using the said complete name in school up to
the present and had never used the family name De Guzman but
instead Dela Cruz;
2. To identify papers and documents in support of the Petitioner;

ATTY. AGOOT: With the kind permission of the Honorable Court:

1. Q: Do you know the Petitioner in this case?

A: Yes, ma’am.
2. Why do you know her?
A: I am her mother, ma’am.
3. Q: Why did she file this petition in this court?
A: To change her family name in her Birth Certificate, ma’am.
4. Q: What are those to be changed or corrected in his Birth
Certificate?
A: Her last name De Guzman be change to Dela Cruz, ma’am.
5. Q: Why did she want to change her family name to Dela Cruz?
 A: She used my family name Dela Cruz since her childhood, ma’am.
6. Q: Why did she used your family name Dela Cruz?
A: Her father and I never get married, ma’am.
7. Q: Why did you not get married?
A: He has another family, ma’am.

A: Yes, ma’am.
9. Do you know that he has another family?
A: No, ma’am.
10. Q: He did not tell you?
A: No, ma’am.
11. Q: Where did you meet him?
A: We are both an employee of a grocery mart in San Fernando
City.
12. Q: Did you ask him if he is married?
A: I asked him, ma’am.
13. Q: What did he say?
A: That he is single, ma’am.
14. Q: You did not saw him wearing any wedding ring?
A: No, ma’am.
15. Q: When and where was your daughter born?
A: She was born on March 26, 1990 in San Fernando City, La
Union, ma’am.
16. Q: What is the name of her father?
A: Juan de Guzman, ma’am.
17. Q: Do you have evidence of her birth?
A: Yes, ma’am.
 18. Q: Showing to you this Certificate of Live Birth of one Marilou
De Guzman which was previously marked as Exhibit _______ in the
initial hearing, is this the one you are referring to?
A: Yes, ma’am.
19. Q: Why does Marilou Dela Cruz like to change her family name?
A: She never felt the love and support of her father since her
childhood, ma’am.
20. Q: What name did your daughter use or have been using since
childhood when she went to school up to the present?
A: Marilou Dela Cruz, ma’am.
21. Q: What are the papers and documents that your daughter had
been using Marilou Dela Cruz as her name?
A: High School Diploma, Certifications, Driver’s License and
Postal ID, ma’am.
22. Q: Showing to you these High School Diploma from Tagudin
National High School, National Technical Certificate from Tagudin
Institute of Science and Technology Foundation, Inc, Professional
Driver’s License and Postal ID, are these the ones you are referring
to?
A: Yes, ma’am.

Office, Municipal Circuit Trial Court, Regional Trial Court and
NBI, sir.

This Judicial Affidavit is being executed to attest to the truthfulness

and veracity of the foregoing facts which are based on my personal
knowledge and belief.
