ABAGNALE, JR.)

I, PAULETTE ABAGNALE, of legal age and a resident of


____________________________, after having been duly sworn to in
accordance with law, do hereby depose and say THAT:

PREFATORY STATEMENT

a. Atty. Gil Paulo B. Gomez conducted/supervised my judicial


affidavit in their office address at ______________ City;

b. I hereby answer the following questions propounded as my


judicial affidavit in the above-captioned case, after having been
sworn in accordance with law, fully conscious that I answer the

same under oath and that I may face criminal liability for false
testimony or perjury.

PURPOSE: To testify that there was a big impact on the life of the
accused being a minor during the time me and my former husband
decided to get a divorce decree.

QUESTIONS AND ANSWERS:

1. Q: Could you please state for the record your personal


circumstances?
A:

2. Q: Do you know the accused in this case?


A: Yes, sir.

3. Q: What is your relation to the accused?


A: He is my biological son, sir.

4. Q: Do you have any evidence to prove that the accused is your


biological son?
A: Yes, sir. His baptisma certificate.

5. Q: If that birth certificate will be shown to you, will you be able to


identify the same?
A: Yes, sir.

6. Q: I am showing to you a Baptismal Certificate with Registry No.


_____________ take a look at this and tell this Honorable Court the
relation of this baptismal certificate with the one that you
mentioned a while ago.
A: This is the same baptismal certificate that I mentioned a while
ago.

7. Why are you here in this court?
A: I am here to prove that my son committed the crimes during his
minority without his discernment and the root cause of committing
it, is because of my decision with my former husband to separate
ways and file a divorce decree.

8. Q: When did you file your divorce decree?


A: Me and my ex-husband decided to file the divorce decree some
time in the late 2016 and we told our son, the herein accused about
that and we asked him right there and then that he should choose
and decide between me or his Dad.

9. Q: Do you have any proof about your divorce decree?


A: Yes, sir, the court decision dated Dec. 16, 2016.

10. Q: If that court decision dated Dec. 16, 2016, will be shown to you,
will you be able to identify the same?
A: Yes, sir.

11. Q: I am showing to you the court decision dated Dec. 16, 2016, take
a look at this and tell this Honorable Court the relation of this court
decision dated Dec. 16, 2016 with the one that you mentioned a
while ago.
A: This is the same court decision of our divorce decree that I
mentioned a while ago, sir.

Your Honor we moved that the said court decision dated Dec. 16,
2016 be marked as Exhibit “___”

12. When you asked your son about the said decision, what happened
next, if any?
A: He got mad and cannot accept our decision. He was confused
and lost. He cried and left us our dwelling without any advice
where he will go.

13. Q: After he left your dwelling, what happened next, if any?

A: I lost contact with my son and I left also our dwelling since there
was already a divorce decree, I said good bye to my ex-husband and
I settled the rest of my life with my new husband.

14. Q: As the mother of the herein accused, any words to say before
this Honorable Court for making your son’s life less fortunate?
A: Yes, sir. I felt that I did not do anything for the best interest of
my son, I chose my happiness than his happiness. I did not provide
the comfort of life that he should experience and I know that I
failed being a good mother to him. He was very young and
innocent when me and my ex-husband decided to file a divorce
decree, he did not know what to do, I cannot blame him for having
committed these crimes, if only I can reverse the time and correct
all my wrongdoings, I will do it for the love of my son.

15. Q: What do you ask of this Honorable Court?


A: I am begging the indulgence of the Honorable Court that the
accused be mitigated for having committed the crimes during his
minority and he acted without his discernment and the reason why
he committed such crimes is because of me and his dad for
deciding to have a divorce decree.
