NLRC COVID-19 ADVISORY NO. 12


11 April 2021

For NLRC Offices/Regional Arbitration Branches located in areas which have
been placed under Modified Enhanced Community Quarantine (MECQ) pursuant to
IATF recommendation as approved by the President and in accordance with the
Omnibus Guidelines on the Implementation of Community Quarantine in the
Philippines, as amended, the following guidelines on work arrangements shall be
observed from April 12 to 30, 2021:

A. FOR REGIONAL ARBITRATION BRANCHES (RABs)/SUB-RABs

1. A skeleton workforce shall be maintained in the following units:

a. SENA Unit
b. Complaint Unit
c. Receiving and Docket Unit (RDU)
d. Cashier Unit

The Receiving and Docket Unit of the RAB/Sub-RAB shall receive all
pleadings, motions and other documents addressed to the RAB and any
personnel therein filed personally or thru mail. Likewise, it shall also
receive all requests for Certificate of No Pending Case and Certified True
Copies.

2. For walk-in settlement, parties are advised to submit their notarized


Compromise Agreement and/or Quitclaims, Release and Waiver at the RDU
to be endorsed to the ELA for raffling.

3. The running of the reglementary period for the filing of appeal shall
resume on April 13, 2021.

4. Filing of position papers and other pleadings shall resume on April 13,
2021.

5. Work from home for all other offices/units shall be implemented.


Whenever necessary, supervisors may require the staff to report physically to
the office.

6. Labor Arbiters shall continue to resolve cases and prepare orders in their
respective residences during the quarantine period. The said decisions and
order shall be signed, promulgated, released, and mailed within seven (7)
calendar days from resumption of work. The minimum level of performance
shall still be applied with respect to decisions on the merits.

B. FOR THE COMMISSION PROPER/DIVISION LEVEL

1. A skeleton workforce in the Commission Proper/Division shall be


maintained in the following units:

a. Public Assistance Counter (PAC)


b. Central Receiving and Mailing Unit/Receiving and Docket Unit
c. Cashier Unit
d. Accounting Unit

The Central Receiving and Mailing Unit /Receiving and Docket Unit
shall receive all pleadings, motions and other documents addressed to
the Commission Proper/Division Level and any personnel therein filed
personally or thru mail.

2. The running of the reglementary periods for the filing of Motions for
Reconsideration (MR) , Petitions for Extraordinary Remedies (ER) and other
pleadings shall resume on April 13, 2021.

3. Work from home for all other department/division/offices/units shall be


implemented. Whenever necessary, supervisors may require the staff to
report physically to the office.

4. Presiding/Commissioners, assisted by their respective


Reviewers/Commission Attorneys shall continue working on the draft
recommendation of decisions/resolutions in their respective residences during
the quarantine period. Routing of the recommendation to the other
Commissioners in their Division for their comment and/or observation will start
upon resumption of regular operations.
