Facts on records:

In continuation of this Commission’s order No. 2237 -1/(2)-(Order)-WBIC/RTI/115/19 dated

22.09.2021, the matter has been taken up for hearing today, i.e. on 03.12.21.

Decision:

The matter has been called for hearing as per schedule.

After perusal of records, it appeared to the Commission that SPIO was asked to show cause as to
why fine of Rs. 25,000/- shall not be imposed for not providing the required information and to submit a
written explanation for his absence during the last hearing.

The SPIO submits before the Commission that the last order of this Commission has duly been
complied with and requisite information has already been furnished to the appellant, vide two different
letters of 2018. SPIO further submits that hard copy of the mutation record is not found to be readily
available.

Appellant submits that he has received the requisite information to his satisfaction except for
information pertaining to query No. 4 & 5.

In the light of the above, appellant is directed to inform SPIO regarding his specific
dissatisfaction within two weeks and the SPIO is thereafter directed to furnish query-wise information as
would be specified by the Appellant in the following two weeks to the Appellant and to thereafter
furnish a compliance report. Since the matter pertains to records of a mutation case, which is a
permanent record and the case relates to 2015, which is just six (6) years ago, the SPIO is hereby
directed to conduct a thorough search under his supervision to locate the said records. If the case records
are missing, a General Diary entry should be made in the Police Station under which the office is located
and responsibility fixed on the Assistants/Officers who were dealing with the safe custody of case
records in the office since 2015.

Commission also feels that the matter be brought in to the notice of DL & LRO South 24-
Parganas for taking necessary action.

Date of next hearing will be intimated in due course.
