AFFIDAVIT OF DESISTANCE
I, DEXTER MAGBAGAY GANDIA, Filipino, of legal age, and a resident of Brgy. 93,
Bagacay, Tacloban City, Philippines under oath declare:

1. That I am a victim of a vehicular accident that happened on August 21, 2021 while I
was traversing along Maharlika Highway in Brgy. Combis, Abuyog, Leyte when a
RUSI motorcycle driven by Rhina Riza Estropigan suddenly veered off its lane to
counterflow to overtake another vehicle when it collided with my Yamaha NMAX
damaging its fork and body panels;

2. That I have already entered into an amicable settlement with RHINA RIZA
ESTROPIGAN;

3. That in view of the foregoing, I hereby confess, declare and manifest my ABSOLUTE
LACK OF INTEREST and PERMANENT DESISTANCE from filing suit whether criminal,
civil or administrative arising out of this accident;

4. That I am executing this Affidavit of Desistance to declare the truth of the above-
narrated circumstances and for whatever legal purpose this may serve.
