COMPETENCY ASSESSMENT IN TARIFF

REACTION PAPER IN THE MATTER OF PROTEST


AGAINST THE IMPORTATION OF
ELECTROLYTIC TIN PLATES (ETP)
FROM SOUTH KOREA

The National Steel Corporation protested against the importation of ETP from
South Korea. It is an anti-dumping protest according to Section 301 of the Tariff and
Customs Code of the Philippines (TCCP) as amended by Republic Act No. 7843
otherwise known as the Anti-Dumping Act of 1994 and Article VI of the General
Agreement on Tariff and Trade (GATT) 1994 and Article, by National Steel Corporation
(NSC).
To elaborate, an anti- dumping protest according to Section 301 of the Tariff and
Customs Code of the Philippines (TCCP) is a law to protect Filipino enterprises against
unfair foreign competition and trade practices. With that being said, any imported
products that have similarities with our local products but with a lower price must
receive a complaint to avoid further hurting the Filipino enterprises.To further analyze,
data of the price range - a comparison between the normal value and import value must
be reviewed. The dumping must have less than 2 percent in order terminate the anti-
dumping protest against the said imported product.

After reviewing the given data of the imported products from South Korea in
comparison with the normal value of the local products, it is undeniable that the protest
against the importation of Electrolytic tin plates must not be neglected because it has a
dumping margin ranging from 9.10% to 13.68% which is undeniably higher than 2% .In
conclusion, the electrolytic tin plates from South Korea is very harmful to local products
that has similar use. Therefore, the importation must be discontinued to avoid further
hurting the Filipino enterprises that offer the same product. With that being said, it is
shocking that importation of products like this with a dumping margin higher than 10%
percent are being approved in the customs. This is very harmful and therefore unethical.
Indeed, a stricter system with a stricter implementation of laws and regulations is
needed to not just lessen importation but to totally eradicate this kind of dumping.
