Traders Royal Bank (TRB) sold in a parcel of land to Emergency
Loan Pawnshop Inc. (ELPI). at the time of the sale TRB misrepresented that
the total usable area of the land is 1,143 square meters but the actual total
usable land area is only 140 square meters. ELPI, after having spent to fully
ascertain the actual condition of the property, demanded from TRB the
rescission and cancellation of the property. TRB refused.
Hence, ELPI filed a petition for annulment of sale with damages with
the RTC of Davao. TRB filed a motion to dismiss on the ground of improper
venue, the trial court denied the motion and the motion for reconsideration
of TRB. The CA set aside the decision of the trial court.
Issue: WON the venue of the action is improper since this case involves
pure questions of law.
Ruling
NO. The venue is not improper. The general rule is that the denial of a
motion to dismiss a complaint is an interlocutory order and, hence, cannot be
appealed or questioned via a special civil action of certiorari until a final
judgment on the merits of the case is rendered.
