AN ACT PROVIDING FOR COVID-19 RESPONSE AND RECOVERY
INTERVENTIONS AND PROVIDING MECHANISMS TO ACCELERATE THE
RECOVERY AND BOLSTER THE RESILIENCY OF THE PHILIPPINE
ECONOMY, PROVIDING FUNDS THEREFORE, AND FOR OTHER PURPOSES

Policy Formulation State of National Emergency. - Presidential


Proclamation No. 922, s. 2020, was issued
declaring a state of public health emergency
throughout the Philippines due to the
Coronavirus Disease 2019 (COVID-19).
Thus, Republic Act No. 11469 or the
"Bayanihan to Heal as One Act" was enacted
declaring a state of national emergency over
the entire country to control the spread of the
disease. However, the rise of confirmed cases
of COVID-19, and the serious threat to the
health, safety, security, and lives of our
countrymen persist. The severe disruption to
livelihood and all other productive activity
were reflected in the country's economic
contraction during the first semester of 2020.
In view of unabated spread of the COVID-19
virus and the ensuing economic disruption
therefrom, the existence of a continuing
national emergency is hereby affirmed in this
Act.

Policy Formalization Declaration of Policy. - It is hereby declared
the policy of the State to promote a just and
dynamic social order that will ensure the
prosperity and independence of the nation
and free the people from poverty, particularly
in the aftermath of natural and man-made
disasters, through policies that provide
adequate social services, and promote full
employment, a rising standard of living, and
an improved quality of life for all.

Policy Formulation The policy is anchored to the RA9003
"Ecological Solid Waste Management Act
of 2000." That requires at least 25 percent
of all solid wastes from waste-disposal
facilities is diverted or recovered through
reuse, recycling, composting, and other
resource-recovery activities.
Policy Adoption Role of LGUs in Solid Waste Management -
Pursuant to the relevant provisions of R.A.
No. 7160, otherwise known as the Local
government code and The City 10-year
Ecological Solid Waste Management Plan
Policy Formalization Article 7 Plastic and Polystyrene
Regulation
The main purpose of this policy is to ensure
that all measures are considered by the City
Government to protect, restore, and enhance
environmental quality for sustainable
development

plastic bags
a. Prohibition on the use of plastic bags
on dry goods
b. Regulating the use of plastic bags on
wet goods
c. Regulation on the selling and
distribution of plastic bags within the
public market
d. Individual participation – shoppers

e. Exemption – shall not cover the
primary packaging of products
Section 36. Implementation. The City
Environmental and Natural Resources
Office (CENRO) under the supervision of
the Local Chief Executive is mandated to
implement the provision
Section 37. Administrative Fines and
Penalties. The fines and penalties provided
under Section 10 of Article 5, Section 20 of
Article 7, Section 22 of Article 8, Section
26 of Article 9 and Section 28 of Article 10
shall be implemented through

Policy Evaluation The policy has been strictly implemented by
the LGU in the City of Malaybalay,
especially the CENRO. The policy has some
loopholes since the LGU didn’t provide any
composed pit for biodegradable wastes. As
of this time, there are no formal complaints
or impact of the ordinance since the City has
posted it in October 2021. Article 16.
Miscellaneous Provisions Section 43.
Separability Clause. The policy shall
continue to be in full force and effect unless
declared invalid.
