STATEMENT OF JURISDICTION
The Supreme Court of India said it intended to appoint a retired apex court judge to enquire
into the extra-judicial killing of four men accused of the rape and murder of a veterinarian in
Hyderabad.

Statement of Facts:
 A 26-year-old female veterinary doctor was raped and murdered by 4 young gentlemen
in Shamshadad near Hyderabad. These gentlemen were accused by the Police Officers.
They are alleged to have confessed to the rape and murder of the victim.

 The Police claimed that they have adequate evidence from CCTV cameras and the
victim’s mobile phones. In a TV interview the Police officer in charge stated that based
on the Prima Facie evidence, the accused were remanded to judicial custody for 14 days
 Speaking about the arrest, the Commissioner said, “We were able to nab the four
accused quickly because of intelligence inputs.” He added that the clues from the crime
scene and CCTV helped in promptly cracking the case.

 On the basis of these facts, a large scale protests on November 31 2021 against the
crime which was carried out in front of the Sharda Nagar Police station demanding that
the accused should be either shot or hung

 On December 6, 2021, where the Police allegedly took the accused to the crime for the
reconstruction of the crime, two of them snatched guns and attacked the officers which
prompted the Police to shoot them dead in a counter attack.

Statement of Issues:

 Whether or not the police acted differently to avoid the killing of the accused?
 Whether or not abundant caution not taken by the police when the four accused
persons were arrested?
 Whether or not the four accused persons were secured, handcuffed and properly
searched before they are taken out? All kinds of things can happen if the police are not
careful."
 Whether or not it was an extrajudicial killing? Popularly known in India as an "encounter
killing"

Arguments Advanced
 The commission, constituted by the Supreme Court to probe the alleged encounter of
the four accused in the 2019 rape and murder case, considered the opinion that
advocates appearing for the state of Telangana, the Section 8-B notices and other
parties who have been permitted to file written submissions, should file it on or before
November 23.

 The advocates shall commence their oral arguments on November 16 and after perusing
the documents, evidence and depositions, the commission is of the opinion that the
submissions must, inter alia, address the aspects including the identification and arrest
of the accused namely, Mohd. Arif, Jollu Shiva, Jollu Naveen and Chintakunta
Chennakeshavalu in the police investigation and the alleged illegalities in the arrest of
the accused as claimed by the relatives of the deceased.

Prayer:
 Two petitions were filed in the Supreme Court seeking an SIT probe into the killing of
four persons, arrested on a charge of gang rape and murder of a veterinarian in
 Telangana, by police in an alleged encounter and compensation for their families.
It was alleged that it was a case of "extra-judicial killings" and sought prosecution of
policemen involved in the incident.
 The PIL filed by Mani and Yadav claimed that the alleged encounter was "fake" and FIR
should be lodged against police officials who were involved in the incident.
 The incident is a clear violation of Article 21 (right to life and fair trial) of the Constitution
of India. A person is innocent till guilt is proved.
 However, in the present case, four persons have been declared guilty of gangrape
without any trial.
