Preamble :

The Republic of Neverland is secular State. The Neverlandiard nation wished to establish justice
and liberty. Neverland guarantees the protection of all the people in the exercise of human rights,
their cultures and traditions, languages and institutions in all the 13 islands under the flag of
Neverland and the European flag in the provision of the Universal Declaration of Human Rights of
1789. “Libertas perfundet Omnia luce” (Freedom will flood all things with light) is the motto of
Neverland.

Part I General provisions

1. State Sovereignty

Article 1
Neverland is a multilingual state due to the country’s diversity formed the 23 May 2003. The main
state languages include English, Spanish and Portuguese. All 13 different islands have their
hierarchy of the languages in Neverland. The other languages shall also be official in the respective
Autonomous Communities per their Statutes.

2. Supranationalism

Article 2
Neverland is a member of the European Union. Neverland also participates in international
cooperation within the framework of the United Nations and the Council of Europe, and other
contexts.
Part II Fundamental rights

1. Human rights an animal rights.

Article 3.1
The State authorities shall respect and secure the human rights as they are written in this
Constitution and in the European Convention on Human Rights that are binding for Neverland.

Article 3.2
No act of law or other provision may imply the unfavourable treatment of anyone because they
belong to a minority group because of ethnic origin, colour, or other similar circumstances or on
account of their sexual orientation.

Article 3.3 Neverland recognizes the Third gender, equally as the female and male one. The gender
spectrum is a part of the State in agreement with the Constitution’s fundamental rights.

Article 3.4
Animal rights are moral principles that animals deserve the right to live and not be seen as
disposable objects, without being subjected to the desires of human beings.
2. Freedom of belief

Article 4
Neverlandiard has the right to freedom of thought, conscience and religion, either alone or in
community in public or private, to manifest his own belief in teaching, practice, worship and
observance.

Part III Executive power

1. The president

Article 5
The President is charged with enforcing the laws written by the legislative branch and is
empowered in various ways to fulfil this duty.

Article 5.1
The President shall always be kept informed by the Prime Minister concerning the important
Realm’s affairs and the other 9 minister. The Government is under the chairmanship of the Head of
State when required.

2. The Cabinet

Article 6

The Cabinet conforming of the Prime Minister and the heads of the administrative branch's
departments in the civil government, which is regarded as the top premonitory body with his 9
minister.

Part IV Judicial power

1. Supreme Court

Article 7
The Supreme Court, with jurisdiction, is the highest judicial body in all branches of justice, except
concerning the provisions concerning Constitutional guarantees.

2. Federal courts

Article 8
The basis of organization and operation is under the principle of juridictional unity. The Courts and
Tribunals shall exercise allocated to them by law to guarantee some right.

Part V Legislative power

2. The Senate
Article 9.1
The Senate consists of 26 senators, two from which state (island).

Article 9.2
The Senate is in charge of confirming or rejecting treaties, confirming or rejecting presidential
appointments to office, including the Cabinet, other executive branch officials, federal judges,
including Supreme Court justices, and ambassadors.

3. The House of Representative

Article 10.1
The House of Representatives shares responsibility for lawmaking with the Senate they work
together and collaborate as equals . As conceived by the Constitution, the House was to represent
the popular will, and its members were to be directly elected by the Neverlendiard.

Article 10.2
The organization and character of the House of Representatives can evolve under the influence of
the Government in power.

Article 10.3 Legislative powers foregoing granted shall be lodged in a Congress of Neverland,
consisting of a Senate and House of Representatives.

Article 10.4
Congress follows every procedure closely and limits debate. Debate is practically unlimited in the
Senate, and members have an opportunity to influence legislation individually.

Explanatory Note :

I was inspired by different sources of the Constitution and legal terms; my inspiration for the
Preamble is purely European with the mentions of the human right and the main principles like
liberty and justice. Furthermore, I incorporated a motto, like in the Republic of France; it gives a
personality to my Constitution and makes it more real.

I choose Neverland to be a peninsula; the country is near the Iberian coast. During its conception, I
was thinking about Japan or the Philippines with their different tiny island that inspired me all along
with my work. And like the fact that The Neverland has many languages that made its singularity.
But I also wanted to add that Neverland was in the European Union to show that the country is
powerful and agree to the European Union criteria and ideas.

For the separation of powers, I mixed French and American Systems with a short term Spain
constitution. I used the three of these to have what I like in judicial, executive and legislative power.
It's is easy to understand the functioning of The Republic of Neverland.

But generally, I also read Sweden, Norway, Iceland and Indian Constitution to have different
materials to work with and compare each other to make the best arrangement.

I also keep in mind the opinion of Montesquieu that was for the separation of the three power, for
the perfect equity of the branches. 'When the legislative and executive powers are united in the
same person, or the same body of magistrates, there can be no liberty... there is no liberty if the
powers of judging are not separated from the legislative and executive... there would be an end to
everything if the same man or the same body... were to exercise those three powers.'
So with the separation of powers, I also added the bicameral principle to make room for equality.
The bicameral principle helps to check and prevent the swift and hasty passage of bills, like in the
case of a unicameral legislature.

I encountered some difficulties with the number of articles, only settling with ten articles, in my
opinion, was very short. I have met many challenges, but sometimes comparing Constitution after
Constitution was long, and sometimes I lost myself in all my notes.

To be realistic about my grade and my competence, I would like to say that I expect a rate between
17 and 13. I think that I didn't just do a Constitution but make a country with its idea and
distinction, make a constitution don't work, you need to create the whole system the ideology and
imagine the life in that country. We can't just make the Constitution, and that's all. We need to
surpass the subject and go further in the reflection. All the hard work put into this Constitution
reflects the person who made the Constitution. It's more personal than an essay on a well-defined
subject. This object of reflection helped me better understand the functioning of the different states
around the world.
