The Birth of ICAO

• Convention held in Chicago in 1944

• 52 states drafted a document called Chicago Convention

• Establishes rules of airspace, aircraft registration and


safety and form ICAO

• The Convention went into effect on April 4, 1947

The Chicago Convention 1944

The Chicago Convention was signed on 7 December 1944 by 52


States
• now 191 member States
• revised eight times in 1959, 1963, 1969, 1975, 1980, 1997,
2000 and 2006
• –It is a source of International Air Law;
• –It is the Constitution of the International Civil
Aviation Organization (ICAO).

• The ICAO is a specialized agency of the United Nations.

Strategic Objectives of ICAO

• Safety – Enhance global civil aviation safety;

• Security – Enhance global civil aviation security; and

• Environmental Protection and Sustainable Development of Air

Some Important Articles

• Article 1: Every state has complete and exclusive sovereignty over


airspace above its territory.

• Article 3: applicable only to civil aircraft and shall not be applicable


to state aircraft.

• Article 12: Each state shall keep its own rules of the air as uniform
as possible with those established under the convention, the duty
to ensure compliance with these rules rests with the contracting
state.

• Article 18: An aircraft cannot be validly registered in more than one


State,

Some Important Articles

• Article 29: Documents to be carried. Every aircraft of a shall carry


the following documents :
• Its certificate of registration;
• Its certificate of airworthiness – issued by the state it is registered
• The appropriate licences for each member of the crew; – issued by
the state it is registered
• Its journey logbook;
• If it is equipped with radio apparatus, the aircraft radio station
license;
• If it carries passengers, a list of their names and places of
embarkation and destination; and
• If it carries cargo, a manifest and detailed declarations of the cargo.

Some Important Articles

• Article 39: Anything that failed to meet the airworthiness


requirements or licence that do not meet the standards has to
endorsed

• Article 40: No aircraft with endorsement shall participate in


international aviation except with the permission of the States
whose territory are entered

Annexes of Chicago Convention (SARPs)

• ICAO adopt Standard and Recommended Practices ( SARPs)


for member states to follow.

• This is put in into The Annexes of Chicago Convention.

• To be adopted, required 2/3 vote of the ICAO Council unless a


majority of the ICAO General Assembly vote against it.

Summary

• Chicago Convention establishes rules of airspace, aircraft


registration and safety and form ICAO

• The Convention through its Articles set out rules and


regulations that each member state has to follow.

• ICAO adopt Standard and Recommended Practices


(SARPs) for member states to follow. This is put in into
