Incomplete checklists or missing documentation will delay the processing of your application. Failure to
complete all spaces, even if you question the need for such information, will result in delays for
preparing and thus filing your case with the immigration service. Please be assured that we request
only the necessary to get the application through the USCIS with as few delays as possible (at least

marksheets/transcripts, or other education certifications). DO NOT INCLUDE 10 & 10+2
documents, they are not necessary;
7. Copy of any and all specialized training certificates (certificates in management, computer
courses, etc.);
8. Full copy of Passport, including all blank pages is preferred by the USCIS; however, at a
minimum please provide a clear/legible copy of the biographic (photo) and last pages of the
passport as well as any/all US visa stamps.
9. If you are currently working for the Sponsoring Employer (i.e. this is an extension matter), please
provide a copy of your medical insurance card (helps prove employer-employee relationship as
insurance is only provided to active employees).
10. If currently working in the US (for any employer), copy of pay statements, year-to-date for the
current year.
11. If you are presently in F-1 status, please provide a copy of all forms I-20, along with a copy of
your EAD for OPT; and
12. If you have a pending or approved I-140 with another employer, please provide a copy of the
Receipt and/or Approval notice.
13. If you have a pending AOS application, please provide copies of your AOS Receipt and AP and

The above-requested items/details are NOT optional, they are all required (at a minimum).
**Please do not send multiple-single page attachments or faxes (they will NOT be accepted and
processing will be delayed). Try to combine as many as possible into 2-4 .pdf’s or 1-2 faxes to cut down
on processing time.
Any items emailed in a format other than .pdf, .doc or .zip will be returned for conversion which
will unfortunately delay processing.**

Most persons entering the United States to work will encounter a three-step process:
Getting a petition approved by the United States Citizenship and Immigration Services (“USCIS”).
This process takes anywhere from two to four months (depending on the USCIS Service Center that
covers the place of employment) unless employer/visa Petitioner pays an additional $1,225.00 for
premium processing, in which case the processing time is about three weeks. This step is not required
for persons getting a visa under the L blanket program, under the TN category, or for Canadians who
seek an L work permit.
Getting a visa stamp at an U.S. Consulate or Embassy in a foreign country. This process can take
many weeks or even months (depending on your nationality, the U.S. consular post where the visa
application is processed, and the type of visa). This step is not required for Canadians, and it is not
required for persons who are already in the United States and who will not be traveling internationally.
This step is required for any other person who is or will be outside of the United States and who does not
have the appropriate visa stamp in the passport at the time of entry (or reentry) into the United States.
With limited exceptions, getting a visa stamp now requires a personal interview, and many consular
posts have significant (weeks or months) interview appointment lead times. It is usually difficult or
impossible to accelerate an appointment. At many consular posts there may be an additional period of
up to several weeks between the interview appointment date and the date of return of the visaed
passport.
To minimize potential delay and disruption of travel, if you are or will be required to get a visa
stamp in order to enter the United States, you need to contact the U.S. Embassy or Consulate in
the foreign country where you last lived in order to book an interview appointment for the visa
Presenting the visa stamp (or petition approval notice, if no visa stamp is required) when you
enter the U.S. and thereby getting a Form I-94 Arrival/Departure Record. The I-94 Record is
important for two reasons: (1) it reflects the visa status that you are given, and you should thus check it
before you leave the immigration inspection area to make sure that the visa status on the I-94 Record is
correct and (2) it has an expiration date on it that you must monitor so that you do not stay in the United
States beyond that expiration date (unless a timely extension or change of status is filed for you).
Neither your visa stamp nor your petition approval dates govern how long you can stay in the United
States for a particular visit; it is the I-94 Record that governs the length of your stay.
