NARRATIVE:
VEHICLE 1 WAS TRAVELING WESTBOUND ON HAMILTON AVENUE, APPROACHING THE INTERSECTION OF COURT STREET, WITH AN
UNKNOWN PHASE OF THE TRAFFIC SIGNAL. AT THE INTERSECTION OF HAMILTON AVENUE AND COURT STREET, VEHICLE 1 STRUCK A
PEDESTRIAN INTHE VICINITY OF THE WEST SIDE OF THE INTERSECTION. THE PEDESTRIAN LANDED APPROXIMATELY 15 FEET WEST OF THE
CROSSWALK ON THE WEST SIDE OF THE INTERSECTION.VEHICLE 1 FLED THE SCENE, MAKING NO ATTEMPT TO STOP, IN UNKNOWN
DIRECTION. PEDESTRIAN SUSTAINED LACERATIONS AND BRUISING TO RIGHT THIGH, HIP, AND ABDOMEN AREA. PEDESTRIAN WAS

On Wednesday, February 24, 2021, at approximately 1839 hours, a motor vehicle collision occurred within the confines of the
76th precinct on Hamilton Avenue west bound in the vicinity of Court Street. The collision involved one motor vehicle and one
pedestrian. The pedestrian was seriously injured and removed to Methodist Hospital being listed in likely to die condition by Dr.
Lawrence. At 2324 hours the victim subsequently died due to injuries sustained from this collision. The death was documented
by the NYC OCME office under case number K-21- 08180.
2. REQUEST / CONFIRMATION
The first officers on the scene were identified as Det. Clarke #3510 and P.O. Class # 14630 sector "D" 76 precinct. These officers
responded to a radio run of a aided male at the intersection of Hamilton Avenue and Court street which was then changed to a
10-53 Pedestrian Struck. At 1928 hours Sgt. Ankele, the patrol supervisor assigned to the 76 precinct arrived at the scene and
made a request for CIS over division radio. This request was confirmed at 2015 hours, upon Sgt. Sarman the highway patrol #2
patrol supervisor responding to Methodist hospital and determining the condition of the victim after speaking with Dr. Lawrence.
3. CI Technician
The collision technician for this collision investigation was P.O. Long #4464 and he was assisted by P.O. Sandolo #2615 both
being assigned to the highway district CTG. P.O. Long did prepare all pertinent documents for the on scene investigation such as
the complaint report(s), police accident report, final diagram, and HD-97. P.O. Sandolo did photograph and video the scene as
the assisting officer.
4. Arrival of CIS
P.O. Zaman and I did arrive at the scene at 2017 hours and were met by Det. Coakley and Det. Paul all being assigned to the
highway district collision investigation Squad. The weather was 50 degrees, clear, and the roadway was dark although lighted by
overhead street lighting.
5. Topography
West bound Hamilton Avenue is a one-way roadway with four lanes separated by dashed white lines. Court Street is a one-way
roadway with a designated right turn lane and two travel lanes. There is also a parking lane on the left portion of this roadway.
This intersection is governed by a standard DOT traffic signal for both directions of travel.
There is a standard DOT traffic signal for the intersection of Court Street and Hamilton Avenue with pedestrian painted
crosswalks which were checked by the NYC DOT response person, Mr. Conzatti. Upon completion NYC response checking the
signals they were determined to be in working order and working properly in conjunction with the pedestrian signals.
7. Observations
Upon my arrival I did observe the right three lanes of Hamilton Avenue to be closed via crime scene tape and police vehicles. In
addition no pedestrian foot traffic was allowed in the area of the collision scene as well. I observed there to be a black North face
puffy winter jacket which had tire marks on it as well as substantial blood on it which was from the victim. In addition there was a
black sweatshirt, a brown paper bag with two Heineken Beers(one closed and the other empty. In the vicinity of the blood on the
roadway there was broken glass from another beer bottle which was presumed to be a Heineken bottle as it was green in color.
This beer bottle seemed to have liquid in it when it broke as there was the smell of beer on the scene. The Brown Paper bag was
still upright and undisturbed as if it was placed there. This bag had no signs of it being run over by a vehicle or disturbed in any
manner.
8. Collision Description
Vehicle #1 (Unknown make/model) was traveling west on Hamilton Avenue and crossed the intersection of Court Street. The
victim, a pedestrian is in the right center travel lane and is struck by vehicle #1. The direction of travel is unknown for the victim
crossing Hamilton Avenue. The victim after being struck was located in the right center lane approximately 15 feet west of the
western most part of the pedestrian crosswalk. Vehicle #1 fled the scene by continuing west on Hamilton Avenue. The victim was
removed to Methodist Hospital and deemed to be in serious condition and likely to die by Dr. Lawrence, the attending trauma
physician.
9. Sobriety Tests
No sobriety tests were administered to any parties as the vehicle fled the scene and the pedestrian was seriously injured
necessitating emergency medical care.

Summary of Investigation:
1. On February 24, 2021, at approximately 2030 hours I spoke with while at the scene of this collision. He
told me that he was waiting at the light, and when he began to proceed, he saw what he thought was a bag of garbage. As he
approached the area where the victim was in the street, he noticed that what he thought was garbage, was a pedestrian on the
ground. He said he pulled over to the side of the road, and called 911. He said he exited his vehicle and tried to divert traffic
around the victim. said he didn't see any vehicle strike the victim, and doesn't know what kind of make or model it
could have possibly been. He did not have anything else to add to his statement.

- Not a witness to this collision. He states he was walking from McDonalds and saw the victim
laying in the middle of westbound Hamilton Avenue at the intersection of Court Street, semi-conscious. He does not know which
car hit him. As he walked by, he didn't walk over to the victim and did not have any conversation with him either. He only
observed the victim to be bleeding from the head. He also added that a black and gray van was stopped near the victim but
doesn't know if that was the vehicle that hit the victim.
- Not a witness to this collision. He states he was traveling down Court Street, made a right at the
intersection of Hamilton Avenue and saw a gray van with its hazard lights on stopped in the middle of Hamilton Avenue. Both the
van and the victim were in the middle lane with the van stopped in front of the victim. I asked if he could describe the
van better with regards to it being a passenger van or a work van. He described it to be more like a work van but could not tell me
the make. He also did not know what state the van was registered in. As he passed by the location, he could not remember if
anyone was inside of the van and also doesn?t remember if anyone was standing outside of the van either. He only stopped for
approximately 10 seconds therefore he could not describe the victim or his injuries, only that he remembers seeing the victim
appear to move his head slightly. He called 911 to report that someone was hit by a car and only assumed that because of the
van stopped in front with the hazard lights on. I asked what type of vehicle he was driving to help identify him in any
possibly video surveillance that is collected and to help rule his vehicle out as a possible vehicle of interest. He stated he was
driving a tan colored 2015 Lincoln SUV with "gold" style NY license plates.
- Not a witness to this collision. has been identified as the man operating the
previously described van (a black Ram Pro Master van) that was stopped with it's hazard lights on. He was interviewed on scene
by Det. Paul on the night of the collision and his statement has been documented on a previous complaint follow up report.

Summary of Investigation:
1. On February 25, 2021, at approximately 1200 hours, I did visit 543 Court Street (tire Shop) and was allowed to view and
retrieve video from the worker identified as I compared the date and it was correct the time was behind real time by
approximately 4:00 minutes. I retrieved cameras 1,2,3.
camera #1 - is a view of Court Street and does not capture the collision.
camera #2 - 1830:20 red SUV is observed on Hamilton Avenue toward Court Street and the vehicle is observed to be braking as
it enters the intersection.
Camera #3 - this view is from the interior of the tire Shop looking out to court street and Hamilton Avenue. At time stamp 1829:52
in the upper portion of the video the victim is observed at the corner waiting to cross and then after the last car in the pack he is
not observed walking anymore. At time Stamp 1830:21 red SUV is observed braking through the intersection and a second later
the SUV is moving up and down in the area where the victim was last seen on video.

Summary of Investigation:
1. On February 25, 2021, at approximately 1330 hours, I did arrive at 354 Hamilton Avenue, Sunoco gas station and met with the
worker Kapoor who assisted me in review and retrieval of this locations exterior cameras. This camera system was ahead of real
time by approximately 28 minutes, the date was correct. This camera system captures the collision although the video needed to
be zoomed in and recorded to better observe what transpired. At 01:21 on the recorded video, the victim is observed on the far
corner of the zoomed in location. I placed the cursor in the recorded video to provide a better idea of where this collision took
place. At 01:42 the victim is observed crossing the street and for an unknown reason falls face down on to the roadway of
Hamilton Avenue. At 01:45 the victim was observed sitting up while in the roadway. At 01:59 it appears the victim is lying in the
roadway. At 02:00 a SUV (target vehicle) is observed driving in the vicinity of where the victim was last seen lying down and then
the target vehicle is observed moving up and down vigorously consistent with hitting a pedestrian on the ground. This video and
the others exterior cameras recovered are attached to this document although none of the cameras are assigned or designated
to differentiate them from another other than the views observed.

1. On February 25, 2021, at approximately 1330 hours, I met with the car wash manager who allowed me to view and
retrieve video from the exterior cameras at his location 354 Hamilton Avenue. The camera is positioned at the entrance of the car
wash with a view of Hamilton Avenue.
At time Stamp on the video player 03:38 the red SUV is observed on Hamilton Avenue going from top right to left by the gas
station price sign just to the left of the police van.

vehicle. I did speak to a company's employee, informed me that he does not have access to the cameras. He

capture the target vehicle on 02/17/2021 at "18:34:28" traveling on Hamilton Avenue. At this time I was unable to download the
video due to no DVR at the site. Laurence informed me that he does not know where is the DVR system and I have to speak to

Summary of Investigation:
1. On February 25, 2021, at approximately 1600 hours, I did visit 353 Hamilton Avenue and met with the owner who
allowed me to view and retrieve video from his video system. The video system is approximately 4 hours and 11 minutes ahead
of real time and the date was correct. The exterior video is of Hamilton Avenue and Court Street. At time Stamp 2245:24 The
victim is observed in the upper right side of the video, 4 seconds later the victim is observed to be crossing Hamilton Avenue and
falls to the roadway.
2245:43 the traffic signal is observed to change from green to yellow and the SUV enters the intersection on a yellow light. as the
vehicle continues straight the traffic signal turns to red and at time stamp 2245:47 The SUV is observed to move up and down in
the area where the pedestrian is last seen crossing the street.

Summary of Investigation:
1. On February 25, 2021, at approximately 1700 hours, I did recover 2 videos from 588 court street with the authority and
permission of the owner. This video is correct to the date and time stamp as compared to real time. He allowed me to
view and download the videos from the exterior of his building and the subject vehicle ( Red SUV) is seen at 1832:12 on camera
# 7 turning right from court street onto Bush Street heading toward the collision scene. This vehicle is red and is observed to
have LED head lights, a hitch and roof racks.
Camera #1 provides a view of Hamilton Avenue and the red SUV is observed at time stamp 1834:41 seconds crossing Court
Street seconds prior to the collision.

1. On February 28, 2021, at approximately 1630 hours, I obtained a copy of the invoiced clothing recovered from the scene which
was vouchered as investigatory and sent to the lab for analysis. The lab request is also attached to this follow up report which
requests that the clothing be analyzed for paint and glass fragments. The invoice was prepared by P.O. Jovin assigned to the
76th precinct.

1. On March 1, 2021, at approximately 0930 hours, I did recover video from 622 court street with permission and authority of the
manager of NYCT Automotive, This DVR time stamp was behind real time 1:00 minute and the date was correct. I did
recover channels 1 and 2.
camera #2 - 1830:11 the red SUV ( target vehicle) is observed at the top of the screen heading toward the camera. The LED
lights are clearly observed on this RED SUV with a white front plate and continues until time stamp 1830:20 as it leaves the
camera frame and is picked up on the next camera, #1.
Camera #1 - 1830:20 The red SUV enters the cameras view and the roof racks with crossbars are clearly observed. In addition
the rear license plate is clearly white in color. The vehicle leaves camera view at time stamp 1830:26

1. On March 1, 2021, at approximately 1300 hours, I did retrieve video from 561 Court Street Brooklyn, NY after serving a
subpoena on Acacia Network at their request. This video was recovered and the date and time stamp was determined to be
correct. The Director provided me access having permission from Acacia Network Legal

1. On March 1, 2021, at approximately 1330 hours, I did recover video from 577 court street which was remote access gained via
computer. The location where I was to obtain a copy of this video was at 110 50 Street where I was provided videos from 577
court street by the owner and manager The (3) videos provided the following account as the DVR was correct to the date
and time stamp as compared to real time.

Summary of Investigation:
1. On March 1, 2021, at approximately 1640 hours, I did receive and review the videos recovered from the loss
prevention officer from White Cap protection. He provided (3) videos which require a player to watch the video. I attempted to
convert the videos from MJP file to AVI but was unsuccessful as only the first minute will convert and save. I have attached the
documents emailed to me and the 3 videos are synced to play at one time through the DV player.
2. Video camera identified as "Hamilton avenue left shows Hamilton Avenue where the Red SUV makes
a U-turn to head toward
the collision at time stamp 18:34:20
3. Video camera identified as "Hamilton Avenue right show the start of the turn only lane on Hamilton Avenue and the red SUv is
observed pulling up and stopping for the red light at time stamp 1833:50 - 1834:34.
4. The other video is of poor quality and does not capture the area where the red SUV
turns.

1. On March 2, 2021, at approximately 1040 hours, while present at 556 Columbia Street, which is a private education center,
BASIS Independent Brooklyn, I collected the video footage of target vehicle from , which was previously

accurate to real time. The target vehicle was captured by three (3) exterior cameras, labeled as " Outside Columbia - .32, Outside
Overlooking Sig Playground and Outside PTZ Bay .45. What these cameras captured is described below.
Camera is affixed to the exterior of the location on the west side of the street on Columbia Street. This camera faces north east
and captures the intersection and the vehicular traffic on Columbia Street and Bay Street.
At 02:27, the target vehicle can be observed from the top right side of the video footage, traveling north bound on Columbia
Street.
At 02:35, the target vehicle can be observed making a right turn, now heading east bound on Bay Street.

1. On March 2, 2021, at approximately 1110 hours, I received an email from the NYC AEU (Automated Enforcement Unit) which
provided me a speed camera which shows the intersection of Court Street and Bush Street.
Time Stamp on video player - 04:07 Red SUV is observed on Court Street and making a turn on to Bush Street at 04:14. This
video shows clearly a red Honda Pilot with roof racks and crossbars, LED head lights, white front plate and a trailer hitch
extending out past the rear bumper. I have attached the videos sent to me via email. The third clip is the video with the RED SUV,
Honda Pilot.

Summary of Investigation:
1. On March 4, 2021, at approximately 1230 hours, I did interview the passenger of the vehicle involved in this collision, Mr.
I was told that had called him to let him know that I was going to call him about the car collision. Mr.
stated the following: his friend was driving a red Honda Pilot and picked up in NYC, specifically Union
Square. He was picked up so they could drive to the IKEA in Brooklyn (by the water) to pick up some shelving for a third friend
not in the vehicle. Mr. Stated they went over a bridge but not sure which one and went IKEA. was the only
person driving going to IKEA and on the return trip. When they wee done shopping they loaded the items in the rear of the Honda
Pilot and then they started to look for locations to eat food. Mr. explained they were on their way to the "Taco Spot"
when as they were on Hamilton Avenue (under the highway) the Honda Hit a manhole cover. The description was very detailed
of the man hole cover as it was circular with little holes surrounding it. I said this is what you saw and he said yes. I was also
informed that Brooklyn has a lot of pot holes and that the roadway was very dark. I replied that if the roadway was dark how can
you describe the man hole with such detail? He said this is what he saw. Mr. stated that after they hit the man hole
cover they pulled over to the taco place just down the street from Court Street and was there about 10 minutes as the food was
being cooked. He stated at some point walked over in the direction of the police lights (collision scene) and a short time
later he returned but nothing was said as could not see much from the Gas Station. I asked if there was ant damage to the
Honda and he said no there was nothing that they saw because they looked. I stated that I would be in contact with him in the
future if there were any other questions and he said that would be fine.

1. On March 4, 2021, at approximately 1300 hours, Det. Coakley and I arrived at 142 west 9 street Brooklyn, NY (Taco
Restaurant) and met with the owner who allowed me to view and retrieve videos from his building from the date of the
collision 2/24/2021. I checked the date and time stamp which was correct to real time and date. I retrieved cameras 1,2,3,4 which
are attached to this document.
This review is for camera #2 as this view has the broadest view of the interaction of the driver and passenger of the involved
vehicle and its parties. the other cameras have limited views but can the time stamps can be used to view other angles.
1835:17 - Subject vehicle pulls up and parks on Hamilton Avenue in front of 142 west 9 street.
1836:44 - driver and passenger of red SUV exit vehicle. Passenger is wearing all black with long hair and black baseball
cap(backwards). Driver ( is wearing all black with sweatpants with white stripes.
1837:05 - driver looks in direction of emergency lights toward Court Street and Hamilton Avenue and enters restaurant.
1840:20 - marked police vehicle observed pulling up on west 9 street and Hamilton Avenue
1840:50 - driver exits taco front door looks in direction of emergency lights.
1841:52 - P.O. Lavaud enters restaurant and driver with passenger of red SUV stay outside.
1850:38 - driver and passenger enter RED SUV and leave location on Hamilton Avenue in direction of BQE.

1. On March 7, 2021, at approximately 1620 hours, P.O. Lavaud # 14927 assigned to the NYPD PSA 1 did arrive at my office
located at 2900 Flatbush Avenue to review video from 142 West 9 street, Brooklyn, NY ( taco restaurant). I showed the video to
him and his 20-30 second interaction with I was informed that P.O. Lavaud does not recall the brief conversation
which took place and could not speak on whether stated there was a pot hole at the block prior to the taco
restaurant. I was also informed that there was no conversation saying that he was involved in a collision and that he needed a
report. I was informed that P.O. Lavaud, although he cannot recall the conversation he would have remembered a conversation
like what was just described above.

1. On March 8, 2021, at approximately 1700 hours, Sgt. Healy and I while inside the parking lot of Highway #2 located at 2900
Flatbush Avenue did complete a search of the undercarriage of the suspected vehicle involved in this collision via a consent to
search from the owner. I did recover fibers from three different areas under the vehicle and invoiced them to be tested and
compared to the victims clothing(outermost garment). This invoice is 3001320123 and the lab request is 99000420047. I have
attached these prepared documents to this report. In addition I did photograph the items (fibers) prior to retrieval from the vehicle.

Summary of Investigation:
1. On March 17, 2021, at approximately 1200 hours, P.O. Zaman and I assigned to the collision investigation squad did arrive at
to meet and speak with the driver of the vehicle involved in this collision,
Present at this time was Attorney, Michael Dreispoon. We did meet in gather in the conference
room within his office and started to speak about the collision. I began the meeting/interview by providing all parties a video to
view which was recovered from the Sunoco Gas station opposite of the collision. Upon viewing this video I explained that I was
not going to rehash questions which were answered in my prior interview but did want to speak about actions after
he had pulled over in the vicinity of the taco restaurant. I asked if he could explain how far he walked toward what he
described as "commotion"...emergency lights, fire truck, and ambulance lights. I was advised he went to the gas station. I
explained that he is not being truthful or is mistaken and this is when I provided (2) photos of Hamilton Avenue from the Sunoco
gas station. These photos were obtained from Google maps. I then pointed out to that he had walked further on
Hamilton Avenue then previously described. He then stated he was not sure how far he walked down Hamilton Avenue but when
he stopped after walking down the road he could not see what had occurred because he was too far away so he ran back to his
friend. I asked why he ran back? explained that he was not sure. I then asked why would you run back to your friend
if you didn't see anything? he said he was not sure. I then stated explain why you would walk down two-thirds of the way toward
the emergency lights and not continue until you could see what was going on? He stated he was not sure. I replied, because you
saw what you needed to see so describe what you saw. This is when he explained that he observed many emergency personnel
on the street (Hamilton Avenue) in sort of a circle, but was not close enough to observe what exactly had happened. I asked was
this near the "pothole" which you stated you had hit and he replied yes. I said do you think the EMT's, FDNY, and Police were
attending to a pot hole? He said no. I then said " you ran back toward the taco restaurant to meet up with your friend? He said
yes. I asked what was the conversation? He said " there is a lot of people down there and something happened" I asked if he
thought maybe his car may have caused this person to be injured? He said no because I did not ever see anyone and neither did
my friend. I was told that there was no back and forth conversation with his friend at any time relating to if either thought they
were involved at all. I circled back several times about his conversations with his friend after he returned from walking down the
street and continued to state the same as what is documented above.

1. On May 3, 2021, at approximately 1500 hours, I did analyze the phone records obtained and looked at the date 2/24/2021
between the hours of 2330-0130 hours. I had to account for the conversion from UTC to EST time which on the date of the
collision was minus 5 hours. I have attached the phone documents analyzed and highlighted to this report. I identified that phone
number is from driver involved, and the other phone number identified is . A total of
ten calls were either received or made between these two numbers post collision, the longest duration was 4 minutes and 18

2. The pedestrian/victim sustained severe head and torso injuries. He was listed in serious condition at Methodist Hospital and
was "Likely to Die". The victim did succumb to his injuries and was pronounced DOA at 2324 hours on February 24, 2021 at
Methodist Hospital.
3. I did confer with ADA Snyder of the Kings County District Attorney's Office regarding this investigation. He agreed with me that
there are no criminal charges to be filed as a result of this collision.
4. I have conferred with the Collision Investigation Squad supervisor, Sergeant Healy, prior to closing this investigation.
