1. Why is a constitution considered as the “highest expression of
the law”?
As the Constitution is the foundation of guaranteed rights of
the people and for the people in any nation. And also something that every country has in its possession and, all constitutions around the world are unique in their way but share the same objective, which is to ensure that there remains stability in the nation. It is something that proscribes the limits and boundaries of the governments' interaction and powers. The Constitution works as a means by which the government in the rule knows as to what extent they can impose rules and regulations on the citizen of the nation. The Constitution of any nation is essential because it lays down all the legal and cultural aspects under which its people and the governmental bodies will be governed. The executive, the legislature and the judiciary are the main organs of the government that the Constitution establishes. These three are the source of stability of any country, and without them, there shall be chaos, reign of terror, and corruption among the masses. That is why it is said to be the highest expression of the law. 2. How important is the Malolos Republic Constitution with regard to the ideas and provisions that it introduced?
The Malolos constitution is the first important Filipino
document ever produced by the people's representatives. It is anchored in democratic traditions that ultimately had their roots in American soil. It created a Filipino state whose government was popular, representative and responsible with three distinct branches the executive, the legislative and the judicial. The constitution specifically provided for safeguards against abuses, and enumerated the national and individual rights not only of the Filipinos and of the aliens.
3. the drafting of the Malolos Republic Constitution. In your
opinion, why was this issue controversial at that time?
The separation of church and state became a rather
controversial topic in the drafting of the Malolos Constitution May Ann P. Bautista 21-BSA-02 because, some of the officials present there probably couldn’t even imagine the said separation. When we were still under the Spanish colonial government, there was no separation of the Catholic Church and the government, and since they colonized us for 333 years-a very long time the Filipinos just got used to this system and didn’t open their minds to the opposite possibility.
