COMPROMISE AGREEMENT

1. This Compromise Agreement is entered into between the parties,


CESAR AVILES represented by MARIA VICTORIA CARLOS (as
“First Party”) and ROBERTO MIRANDA, TERESA AVILES
MIRANDA, JOHN MARBERT MIRANDA, KRIZBELLE LYN
MIRANDA CALIBUSO (as “Second Party”).

2. The First Party agrees to pay the Second Party the amount of
Twenty Thousand Pesos (Php. 20,000.00) as reimbursement for
the expenses incurred by the Second Party in the BAYWAD and
CENPELCO subscription and installation.

3. The First Party will allow the Second Party to remove only the
following improvements made to the house owned by the First
Party:

3.1 Steel Gate;


3.2 Steel Fence at the front;
3.3 Garage;
3.4 Improvements made at the back and front portion of
the house as depicted in the photograph submitted by the
Defendants in their Answer.

4. The Second Party shall remove the said improvements with care
and shall not cause any damage to the structures wherein they
were built. The Second Party shall bring their garbage and debris
caused by the removal of the above-mentioned improvements.

5. As to personal properties, Second Party shall leave the following:

5.1 The Curtain Rod;


5.2 Air condition bought by the First Party;
5.3 Carpet;
5.4 Refrigerator;
5.5 Decorations bought by the First Party;
5.6 Glass and decors bought by the First Party.

6. The Second Party shall not cause any material damage to the
house and shall allow the First Party or any representative to
inspect the house twice: First is upon signing of this document in
the presence of Barangay officials to see the condition of the
house and the second is within two (2) weeks before the last day
given to the Second Party.

7. The Second Party three (3) months to peacefully vacate the


property which shall commence upon the signing of the
Compromise Agreement.

8. The payment of the Twenty Thousand Pesos shall be made once


the Second Party has settled the Electric and Water Bill due to
them. In the alternative, if the Second Party refuses to pay, the
amount to be paid shall be deducted to the Twenty Thousand
Pesos (Php. 20,000.00) as reimbursement.

9. The Second Party undertakes to respect the ownership and


possession of the First Party and shall not return to the said
house.
