On February 21, 2022, Pssg Kungfu Panda testified that on February 6, 2022 he

received an information that the accused was selling illegal drugs and he conducted
validation to prove the validity of the operation. To prove this testimony, he identified the
Pre-operation report which was found in page 16 and was previously marked as “Exhibit
C” during the pre-trial. He testified that he coordinated with the PDEA before the
conduct of the buy bust operation. To prove his testimony, he identified a Coordination
form which is found in page 17 and was previously marked as ‘Exhibit D” during the per-
trial. In his testimony he stated that during the buy bust operation when he conducted
body search, he was able to recover from the accused one (1) piece glass pipe tooter
with dried marijuana leaves, one (1) piece One Thousand Peso Bill (P1,000.00), one (1)
disposable lighter, and one (1) cellular phone Real MI5. He further testified that he put
his initial to all the seized items and was able to identify each when showed to him. He
also stated that he conducted inventory of all the items seized during the buy bust
operation and to prove his testimony, he identified the Inventory Receipt of Properties
which was previously marked as “Exhibit B” during the pre-trial. After the conduct of the
inventory of the seized items, he testified that he took custody of the seized items and
went to the SFC Police Station for further documentation and request for Laboratory
Examination Request and Drug Test Request. To prove his testimony, he identified the
Request for Laboratory Examination found in page 18 and Request for Drug Test found
in page 19 and was previously marked as “Exhibit E and F” respectively during the pre-
trial. After obtaining the necessary documents he turned over the non-drugs items to the
evidence custodian Herman Bruno and the drug items to Melvin Micu in the Crime
Laboratory for the examination. To prove his testimony, he identified the Chain of
Custody Form found in page 21 and was previously marked as “Exhibit G” during the
pre-trial.

PMsg Coco Melon testified in the witness stand on February 28, 2022. In his
testimony he stated that they conducted a pre-deployment briefing initiated by OIC
PLTCOL Solomon B. Taylor. During the pre-deployment, he was tasked to act as the
poseur-buyer. A pre-arrange signal was also made to give a signal with the other
members that the sale was consummated. After the pre-deployment briefing, he
prepared the marked money, he put his initials on the marked money and recorded it in
the blotter. To prove his testimony, he identified a marked money which was previously
marked as “Exhibit” during the pre-trial. He testified that when they arrived in Jolibee
Sevilla, where the buy bust operation will take place, other team members pre-
positioned themselves while he and the confidential civilian agent proceeded to the
parking lot and waited for the accused. When the accused arrive, the confidential
private agent introduced him to the accused as the interested buyer. He then asked if
how much is the cost of two (2) sachet of marijuana and the accused answered that it
costs 1,000 per sachet. He told the accused that he wanted to buy one (1) sachet. The
accused brought out one (1) sachet of marijuana and after handling it to him, he asked
for the payment. He handed to the accused the One Thousand Peso Bill marked money
and just after handling to the accused he made the pre-arranged signal that the sale
was consummated by scratching his back. To prove the identity of the accused held
during the buy bust operation, Coco Melon pointed the accused in the court room. Upon
scratching his back, the other team members immediately proceeded to their place to
arrest the accused. Upon arresting the witness, Coco Melon put his initials on the plastic
heat sealed marijuana leaves and was included in the inventory. To prove his testimony,
he identified the plastic heat sealed dried marijuana leaves which was previously
marked as “Exhibit” during the pre-trial.

On March 3, 2022, Juan Tamad, the Punong Barangay of Sevilla, City of San
Fernando, La Union testified in the witnessed stand that he is currently in their house
near the barangay hall of Sevilla when he was informed that he will be attending to
witness the conduct of a buy bust operation in Jolibee Sevilla. He stated in his testimony
that he personally knew the accused since they live in same barangay. He stated that
he personally witnessed the conduct of inventory of the seized items in the place where
the buy bust operation was conducted. To affirm his testimony, he confirmed that the
signature in the Inventory Receipt of the seized items was indeed his signature.
A representative from DOJ, Mr. New Jersey testified on the witnessed
stand on March 7, 2022. In his testimony, he stated that on February 6, 2022 he was in
his office in the Hall of Justice in Barangay Sevilla when he received a telephone call
that he will attend the pre-operation meeting and he need to witness a buy bust
operation as representative of the DOJ. He proceeded to Jolibee Sevilla. He personally
witnessed the arrest of the accused and the conduct of inventory count of the seized
items made by Kungfu Panda. He also attested that Kungfu Panda made the inventory
in the place where the buy bust was conducted. To prove his testimony, he confirmed
that he signed the Inventory Receipt. To affirm this, he identified his signature on the
Inventory Receipt which was previously marked as “Exhibit B” during the pre-trial.

On March 9, 2022 Dr. James Bond, a forensic chemist from the Crime
Laboratory testified that he is the forensic chemist who conducted the laboratory
examination of one transparent heat sealed plastic sachet containing dried marijuana
leaves and one glass pipe tooter with dried marijuana leaves. He stated that at around
3:00 PM PINSP Melvin Micu of San Fernando police Station handed over to him a
request for laboratory examination together with Chain of Custody Form and one
transparent heat sealed plastic sachet containing dried marijuana leaves with signature
and one glass pipe tooter with dried leaves. He wrote his name and affixed his signature
as the time and date in the Chain of Custody Form to indicate that he duly received the
specimens for examination. To affirm his testimony, he identified his signature in the
Chain of Custody which was previously marked as “Exhibit G-2” during the pre-trial. He
also testified that the specimens he received was properly marked. Upon receiving, he
immediately weighed the specimens using Analytical Balance then proceeded to the
laboratory for the execution of the examination which took for almost 3 hours. After the
examination of the specimens, he turned it over to the evidence custodian. He
confirmed in his testimony that the specimen he examined was positive with Cannabis
Sativa L, a dangerous drug. To affirm his testimony, he identified a copy of the
Chemistry Report and confirmed his signature thereon which was previously marked as
‘Exhibit H” during the pre-trial.
