Section 23. FSS Act 2006
• Packaging and labeling of foods:-
• No person shall manufacture, distribute, sell
or expose for sale or dispatch or deliver to any
agent or broker for the purpose of sale any
packaged food products which are not marked
and labeled in the manner as may be specified
by Regulations.

The expression Package
wherever it occurs shall be
construed as Pre Packed
Food.
Pre packaged or Pre
Packed food means food
which is placed in a
package of any nature , in
such a manner that the
contents can not be
changed without
tampering it and which is
ready for sale to the
consumer
Packaging-General requirements
• Do not use containers which are rusty,
enamelled but chipped and rusty
• Copper or Brass not tinned
• Aluminium not conforming to IS 20, IS 21
standards.
• Plastic not conforming to BIS standards
Food Grade Plastic
• In case of cylindrical or nearly cylindrical, round or nearly round, oval or nearly oval
container, twenty percent of the product of the height and average circumference of
such container; or
• In the case of container of any other shape, twenty percent of the total surface area of
the container except where there is label, securely affixed to the container, such label
shall give a surface area of not less than ten percent of the total surface area of the
container.

General Requirements
Compound
Ingredients
shall be
declared by a
list in Bracket.
• Where an ingredient itself is the product of two or
more ingredients, such a compound ingredient shall
be declared in the list of ingredients and shall be
accompanied by a list, in brackets, of its ingredients
in descending order of weight or volume as the case
may be:
Provided that where a compound ingredient
constitutes less than five percent of the food, the list
of ingredients of the compound ingredients, other
than food additives, need not to be declared
• When a claim is made on the amount or type of fatty acid or the amount of
cholesterol, the amount of saturated fatty acids, monounsaturated fatty acids and
polyunsaturated fatty acids in g and cholesterol in mg should be declared. Along
with this, the amount of trans fatty acids in g should also be stated.

• The proprietary food must comply with all the labeling requirements
specified above
– In addition to this, the name of the food and/or the category under
which it falls in these rules shall be mentioned
– Also should comply with all regulations under this Act and Regulations
‘Proprietary Food’,
(Amendment)
for the sub-regulations 2.12.1, the following shall be substituted,
namely: - “2.12.1: For the purpose of these regulations, -

• Regulation 2.5

which is misleading or contravening the
provisions of Food Safety and Standards Act,
or Rules and Regulations made thereunder.
