or expose for sale or dispatch or deliver to any
agent or broker for the purpose of sale any
packaged food products which are not marked
and labeled in the manner as may be specified
by Regulations.

Important Terms

DATE OF MANUFACTURE means the date on which


the food becomes the product as described

DATE OF PACKAGING means the date on which the


food is placed in the immediate container in which
it will be ultimately sold

 PRINCIPAL DISPLAY PANEL means that part of a label which is intended or likely to
be displayed or presented or shown or examined by the customer under normal
and customary conditions of display sale or purchase of the commodity contained
in the package

 Wholesale package means a package containing —


(a) a number of retail packages, where such first mentioned package is intended
for sale, distribution or delivery to an intermediary and is not intended for sale
direct to a single consumer; or
(b) a commodity of food sold to an intermediary in bulk to enable such
intermediary to sell, distribute or deliver such commodity of food to the consumer
in smaller quantities

 Multi-piece package means a package containing two or more individually


packaged or labeled pieces of the same commodity of identical quantity, intended
for retail either in individual pieces or packages as a whole
Manner Of Declaration

Principal Display Panel (PDP)


• PDP- that part of the container/package which is intended or likely to be displayed
or presented or shown or examined by the customer under normal and customary
conditions of display, sale or purchase of the commodity contained therein

• All label information shall be given on the PDP


• All information required on label shall either be
– Grouped together at one place

– Pre printed info. at one place and online info. in
another place
Manner of Declaration

• In the case of a rectangular container, forty percent of the product of height and width
of the panel of such container having the largest area;

• In case of cylindrical or nearly cylindrical, round or nearly round, oval or nearly oval
container, twenty percent of the product of the height and average circumference of
such container; or

• In the case of container of any other shape, twenty percent of the total surface area of
the container except where there is label, securely affixed to the container, such label
shall give a surface area of not less than ten percent of the total surface area of the
container.

General Requirements

• Label in pre-packaged foods shall be applied in such a


manner that they will not become separated from the
container;

• Contents on the label shall be clear, prominent,


indelible and readily legible by the consumer under
normal conditions of purchase and use;

• Where the container is covered by a wrapper, the


wrapper shall carry the necessary information or the
label on the container shall be readily legible through
the outer wrapper and not obscured by it;
General Requirements

• Regulation 2.2 (Chapter 2) lays down the requirements for


labeling of prepackaged foods

• It is mandatory that every package of food should carry a


label that bears all the information required under FSSA

• The label should not carry a false, misleading or deceptive


description or presentation of the prepackaged food and
the labeling should not create an erroneous impression
regarding the character of food in any respect
Important Terms
• “Pre-packaged” or “Pre-packed food”, means food, which
is placed in a package of any nature, in such a manner
that the contents cannot be changed without tampering
it and which is ready for sale to the consumer.

• “Use – by date” or “Recommended last consumption


date” or “Expiry date” means the date which signifies
the end of the estimated period under any stated
storage conditions, after which the food probably will
not have the quality and safety attributes normally
expected by the consumers and the food shall not be
sold;

Labelling-General Requirements
• Label should be in English or Hindi. Regional
language can also be used along with English
or Hindi.
The label shall not be false,
misleading or deceptive or
creating an erroneous
impression of the product.
• The content of the label shall be clear, prominent,
indelible and readily legible.
• The licence/registration number shall be written on
the label
• Imitation shall not be marked as pure

than food additives, need not to be declared

• Added water shall be declared in the list of


ingredients except in cases where water forms part
of an ingredients such as brine, syrup or broth used
in compound foods so declared in list of ingredients.
Nutritional information
Nutritional Information
• Nutritional information is the declaration of the nutritional composition of
the food
• Should always be stated in numerical terms.
• Must be declared per 100g or 100ml or per serving of the food on the label
• This declaration should compulsorily comprise of the following
information-
– Energy value in kcal
– Protein, fat and carbohydrate along with sugar quantity in g
– Amount of any other nutrient for which a nutrition / health claim is
made
• The amount of vitamins & minerals in metric units
• For nutrition declaration made per serving, the amount in g or ml should
be mentioned for reference beside the serving measure
Nutritional Information

• When a claim is made on the amount or type of fatty acid or the amount of
cholesterol, the amount of saturated fatty acids, monounsaturated fatty acids and
polyunsaturated fatty acids in g and cholesterol in mg should be declared. Along
with this, the amount of trans fatty acids in g should also be stated.

• Nutritional Information is not necessary
in case of raw agricultural products, table
salt, sugar, jaggery , non-nutritive
products, packaged drinking water,
packaged mineral water, alcoholic

products that comprise of single
ingredient, pickles, papad, ready to eat
food, food shipped in bulk which is not
for sale as such.
Trans Fat
• The food in which hydrogenated vegetable
fats or bakery shortening is used shall declare
on the label that “hydrogenated vegetable
fats or bakery shortening used-contains trans
fat”.

• Trans fat free(if less than 0.2gm/serving


food).
• Saturated fat free(not exceed 0.1gm/
100gm or 100ml of food)

• Beneficial effect of the food or its

Nutritional claim
• Means that a food has particular
nutritional properties which are not
limited to the energy value but include
protein, fat, carbohydrates, vitamins
and minerals.

normal functions of the body.
Risk reduction
• In the context of health claims
means significantly altering a
major risk factor for a disease
or health related condition

Proprietary Food

Approximately 270 articles of food ranging from different edible oils to


cereals to bakery and milk products that have been standardized
and their quality defined in Food Safety & Standards (Product
Standards & Food Additives) Regulations, 2011

A proprietary food is therefore a food that has not been standardized


under the FSS (Product Standards & Food Additives) Regulations,
2011
Requirement of Proprietary food

• The proprietary food must comply with all the labeling requirements
specified above

– In addition to this, the name of the food and/or the category under
which it falls in these rules shall be mentioned
– Also should comply with all regulations under this Act and Regulations
‘Proprietary Food’,
(Amendment)
for the sub-regulations 2.12.1, the following shall be substituted,
namely: - “2.12.1: For the purpose of these regulations, -

1) Proprietary food means an article of food that has not been


standardized under these regulations, but does not include any
novel food, food for special dietary use, functional food,
nutraceutical, health supplement and such other articles of food
which the Central Government may notify in this behalf.

2) Proprietary food shall contain only those ingredients other than


additives which are either standardised in these Regulations or
permitted for use in the preparation of other standardised food
under these Regulations.

3) Proprietary food shall use only such additives as
specified for the Category to which the food belongs
and such category shall be clearly mentioned on the
label along with its name, nature and composition.

4) Proprietary food product shall comply with the food


additives provisions as prescribed in Appendix A and
the microbiological specifications as prescribed in
Appendix B of these Regulations and all other
Regulations made under this Act.

5) The Food Business Operator shall be fully


responsible for the safety of the proprietary food.”

6. Exemptions from labeling
 Where the surface area of the package is not more that 100
square cm, the Label of such product shall be exempted
from the requirements of List of Ingredients, Lot or Batch
No, Nutritional Information and Instructions for use but
these information shall be given on the wholesale package
or multi-piece packages as the case may be.

 The Date of Manufacture or Best Before or Expiry Date may


not be required to be mentioned on the package having
surface area of less that 30 square cm but these
information shall be given on the wholesale or multi-piece
package as the case may be.
6. Exemptions from labeling
• In case of wholesale packages the particulars
regarding list of ingredients. Date of manufacture/
packing, best before, expiry date labelling of
irradiated food and , vegetarian logo/non vegetarian
logo, may not be specified.

• in case of food with shelf-life of not more than


seven days, the 'date of manufacture' may not be
required to be mentioned on the label of packaged
food articles, but the 'use by date' shall be
mentioned on the label by the manufacturer or
packer.
Prohibitions
– A label shall not contain any statement, claim,
design,device,fancy name or abbreviation which is
false or misleading in any particular concerning
the food contained in the package or concerning
the quantity or nutritive value or in relation to
place of origin of the food

Specific requirements/ restrictions
Labelling of Infant milk substitute and infant food.
“IMPORTANT NOTICE”
• MOTHER’s MILK IS BEST FOR YOUR BABY
• There shall not be a picture of infant or women or
both on the label.
• The words humanized or maternalized or similar
words shall not be used.
• The label shall not exhibit the words ‘”Full protein
Foods” or “Energy Foods” or “Complete Food” or
“Health Food”.

• Edible Oils and Fats
The expressions “super refined, extra refined,
micro refined, double refined, ultra refined, anti-
cholesterol, cholesterol fighter, soothing to
heart, cholesterol friendly, saturated fat free”or
other expressions exaggerating the quality of
the product shall not be given on label.
Edible oils/Fats
• Every container in which solvent extracted oil or
de-oiled meal or edible flour is packed for sale,
shall bear the followings.
• i) the Name, trade name if any, or description of
the solvent extracted oil or de-oiled meal or
edible flour, as the case may be
• ii) If it is not confirming the standards of refined
grade solvent extracted oil, it shall be declared on
labels
• a) “Not for direct edible consumption”
• b) “For Industrial non edible use only”
