Held:
During the hearing of the applications, on behalf of the Respondents it was not
disputed that (i) in case the document comes into existence in anticipation of
litigation for the purpose of seeking legal advice, the document is privileged; (ii) that
the documents which are subject-matter of these applications have come into
existence in anticipation of litigations and (iii) that the documents have come into
existence for being used in the litigation for defence or for prosecution of the
litigation. The only area of dispute between the parties in this regard is that the
dominant purpose of these documents cannot be said to be seeking legal advice or
use in litigation.
