Respectfully submitted under:-
1. That the main matter has been admitted by Hon’ble High Court and now

there is no date is showing in the main matter, but respondent no. xx is

suffering due to the pendency of the present case as the Hon’ble High

Court data record showed on website by showing the matter at serial no.

xxxxxx in admitted regular cases, so no further hearing is shown in the

matter. Now, it is maintaining at regular serial number according to the

below serial number at Hon’ble High Court data base updated by

xxxxxxxxxxxxxxx Department.

2. That the petitioner is old-age person. Now, he is the respondent no. xx

who old aged person is counting the last the days of the life. Whereas, he

has completed his xx years on xx October ,xxxx.

3. That at this stage petitioner is without funds/lively hood pending service

benefit, which is with the petitioner and due to the pendency of present

RSA no. xxxx of xxxx. The life of the Respondent No. x has been

deprived and the Respondent no. xx is senior citizen suffering from old

ailment and various disease which cannot be curable without proper

treatment and for treatment needs money. That she is senior citizen same

has been enrolled and authenticated by xxxxxxxxxxxxxxxxxxxxx,

identity cards for senior citizen have been issued and Identity card no.

xxxxxxxxxxxxxxx on dated xxth of August xxxx at xxxxxxxxxx. A true

typed copy of senior citizen identity card is herewith annexed as

Annexure A-xx.

4. That the Respondent no. xx has completed his senior citizen aged on xxth

October, xxxx and same has been shown from the date of birth from the

Aadhaar Card which has been issued by Govt. Of India. A true copy of

Aadhaar Card of Govt. of India is herewith annexed as Annexure A-xx.

5. That the Respondent no. xx got information that the Hon’ble High Court

has special category for senior citizens and the Respondent no. xx have

filed the application before the xxxxxxxxxxxxxxxxxxxxxxxxxxxxx. A

true typed copy of submission of senior citizen category consideration

the compliance of order dated xxth July, xxxx passed by Hon’ble Chief

Justice by issuing the Performa same is filled by the respondent no. xx

and submitted before the Hon’ble xxxxxx on dated xxth xxxxxxx, xxxx

vide postal Department through postal Receipt No. xxxxxxxxxxx is

herewith annexed as Annexure A-xx.

6. That the Respondent no. xx case is admitted case deserves to be allocate

herein special category, which is been made by Hon’ble High Court for

senior citizen.

7. That the accompanying RSA filed by petitioner is affecting to

Respondent no. xx in old-age. Whereas, the old-age person is waiting the

Ripe fruit at the old-age, no more avoid repetition Para’s is written to as

the facts are not required to the repeated/retreated.

8. That the Hon’ble Chief Justice have passed the order dated xx.xx.xxxx

for benefit to senior citizens, NRI, widows, Ex serviceman for regular

cases be listed on priority bases and order to submit application with

documents and the applicant have already furnished the application with

the xxxxxxxxx after getting the copy from the office of

xxxxxxxxxxxxxxxxx. A true Copy of submitted application is annexed as

Annexure P-xx which has been filed in the pursuance of order dated

xx.xx.xxxx which has been uploaded on xxxxxxxxxxxxxxxx of

download section i.e. reproduced here below:-

“In compliance with the order dated xx.xx.xxxx passed by Hon’ble the

Chief Justice, the detailed proforma, which has been introduced as

supplement to the procedure being followed by Registry for listing of

regular cases of senior citizen, NRIs, widows and Ex-serviceman, is

required to be circulated, so as to ensure that the litigants and/or their

counsel in order to get their regular cases listed on priority bases, will

submit applications, together with the documents, which have been made

compulsory for considering such request.

Applications in the following proforma are required to be submitted by

the parties/counsel for getting the regular cases listed on priority bases:-

1. Name of application: Father’s/Husband Name;

2. Address

3. Case No.

4. Parties Name

5. Date on which the applicant acquired the status of senior citizen

6. Documents required

(i) In case of Senior Citizen

Birth certificate/matriculation certificate. In case of illiterate persons an

affidavit, duly sworn in by the applicant.

(ii) In case of widow

Death Certificate of her husband along with an affidavit of

having no respondent-married.

(iii) In case of Ex-serviceman

Discharge certificate issued by the competent authority.

(iv) In case of NRIs

Requisite certificate from the competent authority

for consideration of request.

Copy of the draft proforma can be obtained

from the office of Deputy Registrar (Writ) and

Deputy Registrar (Judicial)

9. That the case of the respondent no. xx falls under Senior Citizen

Category.

PRAYER:-

It is, therefore, most humbly prayed that this Hon’ble Court may

graciously be pleased to:-

a. Kindly be Allow/Grant for application under section 151 CPC, 1908 in

xxxx no. xxxx of xxxx i.e. (admitted case for direction to list under the

special category of senior citizen category specifically made by Hon’ble

chief justice for senior citizen in the interest of justice for meet the end of

proper in facts and circumstances of the case.
