How labor laws protect employees and employer explain in context of Pakistani labor
laws?

Employees are protected by labor regulations, and various laws provide accurate guidance to
both employers and employees. For employees, it ensures their employer does not discriminate,
harass or unlawfully terminate them. For employer, employment laws ensure the employee
fulfills the established contract. Employment laws are in place to make sure that both employers
and employees are protected. Providing legislation on dismissal, holidays, pay, discrimination
and more, these laws are in place to protects worker's rights while also safeguarding an
employer's interests and keeping the relationship between the two fair.

The constitution of Pakistan contains a range of provisions in terms of labor rights observed in
Part II: Fundamental Rights and Principles of Policy.

 Article 11 of the Constitution prohibits all forms of slavery, forced labor and child labor.
If this law is implemented then children would be safe and protected because people
won’t be able to use them and they ill b protected from child labor.
 Article 17 provides for a fundamental right to exercise the freedom of association and the
right to form unions.
 Article 18 gives the right to its citizens to enter upon any lawful profession or occupation
and to conduct any lawful trade or business.
 Article 25 addresses the right to equality before the law and prohibition of discrimination
on the grounds of sex alone.
 Article 37(e) makes provision for securing just and humane conditions of work, ensuring
that children and women are not employed in vocations unsuited to their age or sex, and
for maternity benefits for women in employment.

Furthermore, employees are compensated in accordance with the following categories:

Leaves

 According to the Factories Act, 1934, every worker who has completed a period of
twelve months of continuous service in a factory shall be allowed holidays for fourteen
consecutive days. If he fails to avail whole leaves the part of un availed leave will be
carried forward in next year.
 The Maternity Benefit Ordinance, 1958 stipulates that upon the completion of four
months employment or qualifying period, a worker may have up to six weeks prenatal
and postnatal leave with pay.
 The Factories Act, 1934 provides that every worker is entitled to 10 days casual leave
with full pay and further 16 days sick or medical leave on half pay.

Health and safety

Further laws emphasize on cleanliness, drainage, ventilation, and hygiene of work place.
Provision of drinking water. All passages, stairs, entrance and exits points must be open and
properly lighted to ensure safety. Constitution of Pakistan prohibits the employment of children
below the age of fourteen years in any factory, mine or

Wages

The Payment of Wages Act, 1936 regulates payment of certain classes of industrial workers. The
act enforce payment of wages within seven days if number of employees workers are less than
1000 in other case with in ten days of completion of wage period.

Working hours

The firm offers a variety of benefits, including overtime pay, night shift pay, and public holiday
pay.

FOR EMPLOER

Employers have certain rights, in addition to the responsibility to appoint potential people
without bias, to provide a safe and respectful work environment, and to equitably reward the
employees. Employees are likely to come into work on a regular basis, on time, and to perform
their tasks in terms of the contract. Employers also have some rights that employers have the
right to terminate an employee if they feel they are not producing the desired impact on their
business or if the business can no longer afford the employee. By understanding and following
employment laws employers, as well as employees, remain protected.

CONCLUSION

Employment law is important for both employees and employer. Employment laws ensure
employees are able to work in a fair and safe work environment and provide that they are fairly
compensated. In return, workers often do their work with higher quality and enjoy each workday
more.
