Question: A sold his residential house to B.

however, A has existing lease of the house to lessee C, which


will expire only after six (6) months. B now as the owner, can he eject C from the house?

Answer: It depends. Under Article 428, par 1, the owner has the right to enjoy and dispose of a thing,
without other limitations than those established by law”. In this case, A has the right to possess, use and
enjoy his new purchased property within the limits prescribed by law. However, the lessee may have
improvements thereon of which he may not be deprived of without due process. Therefore, owner B
may eject C but with the due process.
