PETITION

Petitioner, through the undersigned counsel and before this

Honorable Court, states that:

1. Petitioner VICTOR PEREZ, is 33 years of age, Filipino, single, a

resident of No. 22 Malaya Compound, Pardo, Cebu City and the
paternal uncle of the ward ISABELLA PEREZ;

2. ISABELLA PEREZ, whom guardianship is prayed is a nine-year-

old minor, Filipino and a resident of Unit 2, VS Building, Lahug,
Cebu City;

3. As proof of the relationship between petitioner and the ward,

hereto attached are the respective Birth Certificates of the ward,
the wards’ father PATRICK PEREZ and the petitioner as Exhibits
“A”, “B”, and “C” to form parts hereof;

4. The ward ISABELLA PEREZ is the only child of PATRICK

PEREZ and LARA SANTOS-PEREZ, who both died on 31
January 2022 in a vehicular accident, attached hereto their
respective Certificates of Death as Exhibits “D” and “E” to form
part hereof;

5. The ward is entitled to support from the Philippine Government

in the amount of P20,000 per month as death benefits granted to
the surviving heirs of PATRICK PEREZ who served in the
Philippine Navy since 2006;
 6. Considering the minority of the ward, she cannot properly
manage the monthly pension and other benefits that will be given
to her by the Philippine Government.

7. Petitioner who is a blood relative of the ward, who is financially

capable on his own as he in fact has been spending his own
money to support all the needs of the wards, would be in the best
position to take care of the persons and properties of his niece.

8. Petitioner has been advised by his counsel of his duties and

responsibilities in the event he is appointed as general guardian
of the ward and that petitioner is ready and able to post a bond
in such sum as the Honorable Court may deem proper.

7. Letters of guardianship over the person and properties are

prayed for by petitioner, who is the only sibling of minor’s late
father, and with whom the minor is entrusted every time the
parents of the minor is not capable of performing their obligations
due to work-related responsibilities.

PRAYER

WHEREFORE, premises considered, it is most respectfully

prayed of this Honorable Court, that after due notice and hearing, the
petitioner be appointed guardian over the person and properties of
minor ISABELLA PEREZ and that corresponding letters of
guardianship be issued in his favor.

Such other reliefs and remedies which may be just and equitable
under the circumstances are likewise prayed for.

with law hereby depose and say THAT:

1. I am the petitioner in the above-entitled case;

2. I have caused the preparation and filing of the foregoing

complaint, that I have read the allegations therein, and that they
are true and correct of my own personal knowledge and belief
and based on authentic documents;

3. Other than the foregoing complaint, I have not commenced any

other action or proceeding involving the same issue before the
Supreme Court or Court of Appeals or any divisions thereof or
before any tribunal or agency and that, to the best of my
knowledge, there is no such action or proceeding pending before
any tribunal;

4. If other than the foregoing complaint, I should learn that a similar

action or proceeding has been filed or is pending in any tribunal,
I will notify this Honorable Court of the same within five (5) days
from such notice;

5. The foregoing complaint is not filed to harass, cause

unnecessary delay or needlessly increase the cost litigation and
that the factual allegations on the foregoing compliant have
 evidentiary support or if specially so, identified will likewise have
evidentiary support after a reasonable opportunity for discovery.
