The Price Adjustment Factor (Pn) shall first be applied to the Interim Payment Cerificate covering the work carried out by the Contractor during the thirteenth (13th) month and thereafter as provided for under the terms of the Contract. The adjustment amount of each Interim Payment Certiicate shall be the ‘amount which in the opinion of the Engineer shall be due to the Contractor pursuant to Sub-Ciause 146 [Issue of Interim Payment Certiicates] (before deducting retention) at base rate and prices but excluding Dayworks, provisional sums, the value of materials on site, any adjustment under Sub- Clause 13.7 [Adjustments for Changes in Legislation] and any amount calculated based upon currentprices. Adjustments for Changes in Cost applicable for Part-2: Performance based Maintenance works: Price adjustment for Par-2: Performance-based maintenance works shall only be applicable where an extension of time has been granted to the Part- Construction Phase Works. In that situation price adjustment shall be applied to ‘works carried out in the period beyond the due date for Completion of Part-2 if the extension of time had not been granted for the Part1 works. Such price, adjustment shall be applied to all Bills of the Part2 Performance-based Maintenance works by applying the adjustment factor determined by use of the formula applicable to Bill No. 6 for the Part-1: Construction Phase Works. The base cost indices or prices shall be those prevailing on the Commencement Date of the Part-2: Performance-based Maintenance Works. Current indices or prices shall be those prevailing 28 days prior to the last day of the period to which a particular Interim Payment Certficate is related.
