I, Mr. Rosangliana, Proprietor of M / s Pachhunga and Sons, Accused above named having office address
at Pachhunga Building Chanmari, Village Aizawl, P.O. Aizawl, Aizawl – 796007, Mizoram, do hereby
solemnly state as under:-

1. I say that I am a senior Citizen of ____ years.

2. I say that for last several months I have been facing lots of health problems and have kept very
unwell, which has constrained me from carrying out even my own routine work.

3. I say that I reside in Aizawl, Mizoram where specialized medical infrastructure and care is not
available, hence I was directed to approach North East Indira Gandhi Regional Institute of Health
and Medical Science, Shillong in the Neurology Department for further treatment and care. That
the copies of my medical records are annexed herewith.

4. I say that due to above mentioned reasons I was unable to communicate to the counsels the
grounds and material propositions with respect to cross examinations due to which my counsel
was unable to proceed with the cross examination.

5. I state that, I am still unwell and not in a position to travel to Mumbai, for attending the Court
hearing, however, I have now given instructions my counsel for carrying out cross examination.

6. I state that the delay caused was due to genuine reason, and not a deliberate attempt to delay
the proceedings.

7. I say that, in the said circumstances, the Hon’ble Court be pleased to set aside ‘no cross’ order
dated 20.09.2019 in the interest of justice and recall the witness of cross examination i.e. PW .
No. 1 that is complainant.
