SUBJECT : Request Form for Trajectory Test

DATE : April 27, 2022

1. Request conduct of medico-legal (autopsy) examination on the accompanying


specimen to determine the cause of death.

a) NATURE OF CASE :

Authorities are preparing to charge with homicide the owner of a house in


Las Piñas City where an 11-year-old girl was killed on New Year’s eve.
Initially, her parents thought that she just momentarily lost her balance but
a check up at the Las Piñas District Hospital showed that she had been hit
in the left temple by a bullet from a .40 cal.-pistol

b) VICTIM :

Juni Rubia was based on circumstantial evidence. The victim, Darlene


Gutierrez was watching fireworks display with Rubia’s children at the
second floor of the suspect’s house at Block 5, St. Vincent, Mapayapa
Village, when she suddenly collapsed.

c) SUSPECT :

According to Modequillo, the trajectory of the bullet – a straight horizontal


line – showed that it was fired by someone inside the house. This was
confirmed by their re-enactment of the incident plus the fact that the
surrounding houses in the area were not as high as the suspect’s.

d) Time, Date, Place of Occurrence :


In 7:12pm, on April 27, 2022 a house in Las Piñas City where an 11-year-
old girl was killed on New Year’s eve

e) SPECIMEN SUBMITTED :

Rubia, who underwent a paraffin test after the incident, was also found
positive for gunpowder. His wife’s denial that her husband was not inside
the house contradicted Rubia’s and the playmates of the victim’s
statements that he was inside the house when the incident happened.

2. Further request that this Office be furnished a copy of medico-legal examination


result for our reference.
