Michael Drake P. Matias: ‘This refers to the Notice of Violation duly sent by your Office which was duly received from our end, on 27 JUNE 2022 with the following findings, to wit: #46 Sibesco St, Victoria Village, Canumay East, Valenzuela City Tel no : (02) 758-6798 jifm100527@gmail.com FINDINGS VIOLATED LEGAL PROVISIONS For operating a facility that discharges regulated ‘water pollutants without 2 corresponding Discharge Permit (DP) from this Office. Section 27.1 (c) of DENA Administrative Order (©AO} 2005-10, the implementing Rules and Regulations of RA 9275 Section 14 of DAO 2005-10 provides that the Department shall require owners or operators of facilities that discharge regulated effluents pursuant to this Act to secure a permit to discharge. The Discharge Permit shall be the legal authorization granted by the Department to discharge wastewater. Failure to designate Pollution Control Officer (Pco) ‘Section 27.1 (c) of DENR Administrative Order (DA) 2005-10, the Implementing Rules and Regulations of RA 9275. Further, you have directed this Office to explain in writing, duly notarized, within fifteen (15) days from receipt of the Order why no penalty shall be imposed against our firm for the above violations. #46 Sibesco St,, Victoria Village, Canumay East, Valenzuela City Tel no : (02) 758-6798 jfm100527@gmail.com Hence, this Motion for Reconsideration. JFM ENTERPRISES, INC., is already in the process of securing its Certificate of Non- Coverage. Once the Certificate of Non-Coverage is already approved, we will collate documents ‘and requirements and immediately apply for the Discharge Permit. ‘On tem No. 2: Failure to designate Pollution Control Officer (PCO) JFM ENTERPRISES, INC.,is already in the process of collating documents and requirements for Pollution Control Officer Accreditation. Once completed, we will apply immediately for the accreditation. We hope that al of the above reiterations will result in a waiver of the penalty imposed on our company, as we strive to improve our operations and provide quality goods to the community ‘without compromising the receiving environment. ‘As an advocate of cleaner and pollution free environment and a law-abiding organization of this ‘country, we are compliant with all the necessary permits & clearantes required for our operation. Rest assured that JFM ENTERPRISES, INC. will always conform to the system likewise remain faithful to the requirements and compliance set by the Depart ment and having the trust and confidence that ‘your good office will soon grant us our request. In addition, JFM ENTERPRISES, INC. will observe all ‘appropriate measures to maintain its excellent performance acceptable within the community, clients and the Department standard. Last, JFM ENTERPRISES, INC. is always exerting its best effort to comply with all environmental regulations.
