To prohibit Federal financial participation under Medicaid
for non-emergency transportation provided to access serv-
ices for which Federal financial participation is prohib-
ited.

1 Be it enacted by the Senate and House of Representa-

2 tives of the United States of America in Congress assembled,
3 SECTION 1. SHORT TITLE.

4 This Act may be cited as the ‘‘Defunding Abortion

5 Transportation Act’’.

1 SEC. 2. LIMITATION ON FEDERAL FINANCIAL PARTICIPA-

2 TION UNDER MEDICAID FOR CERTAIN NON-

3 EMERGENCY TRANSPORTATION.

4 (a) IN GENERAL.—Section 1903(i)(9) of the Social

5 Security Act (42 U.S.C. 1396b(i)(9)) is amended—
6 (1) by striking ‘‘(9) With respect to’’ and in-
7 serting ‘‘(9)(A) With respect to’’;
8 (2) by striking at the end ‘‘or’’ and inserting
9 ‘‘and’’; and
10 (3) by adding at the end the following new sub-
11 paragraph:
12 ‘‘(B) with respect to any amount expended for
13 non-emergency transportation authorized under sec-
14 tion 1902(a)(4) if such transportation is for pro-
15 viding access to medical care or a service for which
16 Federal financial participation is prohibited; or’’.
17 (b) CONFORMING AMENDMENT.—Section
18 1902(a)(70) of the Social Security Act is amended by in-
19 serting ‘‘, subject to section 1903(i)(9)(B),’’ after ‘‘at the
20 option of the State’’.
21 (c) EFFECTIVE DATE.—The amendments made by
22 this section shall apply to transportation furnished on or
23 after the date of the enactment of this Act.
