1. The minimum average annual financial turnover of the bidder during the last three years, ending on 31st
March of the previous financial year, should be as indicated above in the bid document. Documentary evidence in
the form of certified Audited Balance Sheets of relevant periods or a certificate from the Chartered Accountant /
Cost Accountant indicating the turnover details for the relevant period shall be uploaded with the bid. In case the
date of constitution / incorporation of the bidder is less than 3-year-old, the average turnover in respect of the
completed financial years after the date of constitution shall be taken into account for this criteria.
2. Experience Criteria: In respect of the filter applied for experience criteria, the Bidder or its OEM {themselves or
through reseller(s)} should have regularly, manufactured and supplied same or similar Category Products to any
Central / State Govt Organization / PSU / Public Listed Company for number of Financial years as indicated above
in the bid document before the bid opening date. Copies of relevant contracts to be submitted along with bid in
support of having supplied some quantity during each of the Financial year. In case of bunch bids, the category of
primary product having highest value should meet this criterion.
3. OEM Turn Over Criteria: The minimum average annual financial turnover of the OEM of the offered product
during the last three years, ending on 31st March of the previous financial year, should be as indicated in the bid

document. Documentary evidence in the form of certified Audited Balance Sheets of relevant periods or a
certificate from the Chartered Accountant / Cost Accountant indicating the turnover details for the relevant period
shall be uploaded with the bid. In case the date of constitution / incorporation of the OEM is less than 3 year old,
the average turnover in respect of the completed financial years after the date of constitution shall be taken into
account for this criteria.
4. Estimated Bid Value indicated above is being declared solely for the purpose of guidance on EMD amount and
for determining the Eligibility Criteria related to Turn Over, Past Performance and Project / Past Experience etc.
This has no relevance or bearing on the price to be quoted by the bidders and is also not going to have any
impact on bid participation. Also this is not going to be used as a criteria in determining reasonableness of
quoted prices which would be determined by the buyer based on its own assessment of reasonableness and
based on competitive prices received in Bid / RA process.
5. Past Performance: The Bidder or its OEM {themselves or through re-seller(s)} should have supplied same or
similar Category Products for 40% of bid quantity, in at least one of the last three Financial years before the bid
opening date to any Central / State Govt Organization / PSU / Public Listed Company. Copies of relevant
contracts (proving supply of cumulative order quantity in any one financial year) to be submitted along with bid
in support of quantity supplied in the relevant Financial year. In case of bunch bids, the category related to
primary product having highest bid value should meet this criterion.

Buyer Added Bid Specific Terms and Conditions


1. Generic

OPTION CLAUSE: The Purchaser reserves the right to increase or decrease the quantity to be ordered up
to 25 percent of bid quantity at the time of placement of contract. The purchaser also reserves the right to
increase the ordered quantity by up to 25% of the contracted quantity during the currency of the
contract at the contracted rates. Bidders are bound to accept the orders accordingly.

2. Turnover

Bidder Turn Over Criteria: The minimum average annual financial turnover of the bidder during the last
three years, ending on 31st March of the previous financial year, should be as indicated in the bid
document. Documentary evidence in the form of certified Audited Balance Sheets of relevant periods or a
certificate from the Chartered Accountant / Cost Accountant indicating the turnover details for the
relevant period shall be uploaded with the bid. In case the date of constitution / incorporation of the
bidder is less than 3 year old, the average turnover in respect of the completed financial years after the
date of constitution shall be taken into account for this criteria.

3. Turnover

OEM Turn Over Criteria: The minimum average annual financial turnover of the OEM of the offered product
during the last three years, ending on 31st March of the previous financial year, should be as indicated in
the bid document. Documentary evidence in the form of certified Audited Balance Sheets of relevant
periods or a certificate from the Chartered Accountant / Cost Accountant indicating the turnover details for
the relevant period shall be uploaded with the bid. In case the date of constitution / incorporation of the
OEM is less than 3 year old, the average turnover in respect of the completed financial years after the
date of constitution shall be taken into account for this criteria. In case of bunch bids, the OEM of
CATEGORY RELATED TO primary product having highest bid value should meet this criterion.

4. Service & Support

Escalation Matrix For Service Support : Bidder/OEM must provide Escalation Matrix of Telephone Numbers
for Service Support.

5. Service & Support

Availability of Service Centres: Bidder/OEM must have a Functional Service Centre in the State of each
Consignee's Location in case of carry-in warranty. (Not applicable in case of goods having on-site
warranty). If service center is not already there at the time of bidding, successful bidder / OEM shall have
to establish one within 30 days of award of contract. Payment shall be released only after submission of
documentary evidence of having Functional Service Centre.

6. Certificates

Bidder's offer is liable to be rejected if they don't upload any of the certificates / documents sought in the
Bid document, ATC and Corrigendum if any.

7. Certificates

ISO 9001: The bidder or the OEM of the offered products must have ISO 9001 certification.

8. Certificates

Material Test Certificate Should Be Sent Along with The Supply. The Material Will Be Checked by Buyer’s
Lab & the Results of the Lab will be the Sole Criteria for Acceptance of the Item.

9. Buyer Added Bid Specific ATC

Special Notes :

. Buyer reserves all rights at any time to reject any tender / bid at any stage
and/or time fully or partly the whole process and/or for particular Tenderer and
also reserves all rights at any time to add, alter, modify, change, edit & delete
any condition at any stage and/or time or vary all or any of these terms and
conditions or replace fully or partly for whole process and/or for particular
Tenderer or vary all orany of these terms and conditions or replace without
assigning any reasons whatsoever. In this regard,the decision of Buyer shall be
final and binding on all the participating bidders.
. Buyer reserves the right to reject any or all tenders / bids and the entire
Tender process without assigning any reason whatsoever.
. Seller need to provide unpriced boq
. Canvassing in any form in connection with tender is strictly prohibited and the
tender submitted by a Tenderer who resorts to canvassing is liable to be
rejected. Test Report for tender items require for cross examine technical
compliances.
. Buyer reserves the right to verify the particulars furnished by the applicant /
tenderer / bidder, independently.
. In no case, the request of Tenderer for change or modification in any terms
and conditions related to payment shall be entertained.

. Buyer reserves the right to modify all or any conditions of Tender documents
at any time. In case of change/amendment in any of the condition(s) of the
Tender, Buyer may issue corrigendum to this tender by notifying the same on
Gem Portal.

. Buyer reserves the right not to accept the lowest or highest bid as the case
may be.
Instruction to Bidders For Preparation of Technical Documentation :

· The bids shall exactly be according to the prescribed formats.


Modifications/Rewording of formats shall not be acceptable. Tender shall be
submitted online on Gem Portal. If Reseller is participate in bid they may use
their OEM credential such as quality document, certificate and past experience
· Bid scrutiny process is organized for once only by the Technical committee.
Seller needs to read the document carefully and provide the desired document
in one attempt only, buyer will not accept any document once tender date is
over. An undertaking needs to be uploaded in a technical bid by the seller at
time of bid participation.
· Tender should be filled with neat legible and correct entries, in distinct figures,
measures. Any alterations will not be permitted in the tender.
· Seller shall provide after sales service support undertaking for one year in
technical bid.
· Failure to comply with the conditions will result in forfeiting of the tender.
Please cross out any mistakes and rewrite the same and counter sign.
· Incomplete tenders, amendments and additions to tender after opening and
tenders submitted after due date shall liable to be ignored.
· Seller need to ensure sufficient warranty and quality for Products or Service
· After the technical representation, the buyer may ask for design or/and
detailed workflow in soft copy or other way. Only that seller will mark as
qualified bidders, whose details match with buyer’s expectation.
· Cost involved in submitting the bids, attending the tender opening meeting,
arrangements for the demonstration/presentation etc. shall be borne by the
bidder.
· Provide Work methodology for execution activity
· Brief compliance for additional terms and conditions require from seller.
· Rates should be offered unconditionally as well as inclusive of all taxes. If rates
are submitted with any condition, the tender shall be rejected.
· Technical compliance is required with bid.
· Bidders must quote rates on the GEM portal and in the Envelope of Financial
Bid. Offer will be rejected if details regarding price bid are mentioned in
technical bid.

· Process Flow Diagram for work completion as per bid requirement.
· Buyer reserves the right to change the quantity/upgrade the criteria/ drop any
item or part thereof/extension of delivery date at any time before placing the
purchase order.
· Right of Acceptance - Buyer does not bind itself to accept the lowest tender.
Bids will be evaluated keeping in mind the quality and technical aspects of the
materials being offered along with the price quoted. Even after qualifying in
Technical Bid, the Financial Bid may not be accepted if found not in order.
Buyer will have the sole discretion in any mater related with the tender.
· Responsibilities and Quality Measurement – The Item supplied should be brand
new and should be installed/commissioned at the locations specified by
Consignee at no extra cost. This office is not bound to provide any mode of
transport in respect of men or material required for the contract. Bidder needs
to ensure the Quality Products, QAP needs to submit in Bid.

Disclaimer
The additional terms and conditions have been incorporated by the Buyer after approval of the Competent
Authority in Buyer Organization. Buyer organization is solely responsible for the impact of these clauses on the
bidding process, its outcome, and consequences thereof including any eccentricity/restriction arising in the
bidding process due to these ATCs and due to modification of technical specifications and/or terms and
conditions governing the bid. Any clause incorporated by the Buyer such as demanding Tender Sample,
incorporating any clause against the MSME policy and Preference to make in India Policy, mandating any Brand

names or Foreign Certification, changing the default time period for Acceptance of material or payment timeline
governed by OM of Department of Expenditure shall be null and void and would not be considered part of bid.
Further any reference of conditions published on any external site or reference to external documents/clauses
shall also be null and void. If any seller has any objection/grievance against these additional clauses or
otherwise on any aspect of this bid, they can raise their representation against the same by using the
Representation window provided in the bid details field in Seller dashboard after logging in as a seller within 4
days of bid publication on GeM. Buyer is duty bound to reply to all such representations and would not be
allowed to open bids if he fails to reply to such representations. Also, GeM does not permit collection of Tender
fee / Auction fee in case of Bids / Forward Auction as the case may be. Any stipulation by the Buyer seeking
payment of Tender Fee / Auction fee through ATC clauses would be treated as null and void.

This Bid is also governed by the General Terms and Conditions

In terms of GeM GTC clause 26 regarding Restrictions on procurement from a bidder of a country which shares a land border with India, any bidder from a country which
shares a land border with India will be eligible to bid in this tender only if the bidder is registered with the Competent Authority. While participating in bid, Bidder has to
undertake compliance of this and any false declaration and non-compliance of this would be a ground for immediate termination of the contract and further legal action
in accordance with the laws.
