SEARCH AND ARREST WARRANT

The State of Texas: To the Sheriff or any Peace Officer of Houston, Harris County,
Texas, or any Peace Officer of the State of Texas:
Whereas, the affiant whose name appears on the affidavit attached hereto is a
peace officer under the laws of Texas and did heretofore this day subscribe and swear
to said affidavit before me (which said affidavit is here now made a part hereof for all
purposes and incorporated herein as if written verbatim within the confines of this
Warrant), and whereas | find that the verified facts stated by affiant in said affidavit show
that affiant has probable cause for the belief he/she expresses herein and establishes
existence of proper grounds for issuance of this Warrant;
Now, therefore, you are commanded to enter the suspected place, vehicles, and
premises described in said affidavit, to-wit: a one story residence located in the "2807
Nettleton". The above location is located in Houston, Harris County, Texas. The
residence is constructed of wood which is white in color. The residence is located on
the east side of Nettleton street. The intersecting street is Tuam. The front door faces
east and has burglar bars attached to it. The numbers "2807" are plainly visible on the
residence. The residence next door (south) has the numbers "2811" plainly displayed
The above residence in question is located in the 2800 block of Nettleton. The most
common address to the above location in question is "2807 Nettleton", Houston, Harris
County, Texas. At said places you shall search for and, if same be found, seize and
bring before me the property described in the affidavit that the suspected party, or
others in control of the suspected place, are alleged to be concealing and to have in
his/her possession in violation of the laws of the State of Texas, to-wit: marijuana.
Further, you are commanded to arrest and search each suspected party named
and described in said affidavit, to wit: a black male, who is known by the street name of
"B". He is approximately thirty (30) years of age, five feet eight inches (5'8") in height
and one hundred and eighty (180) pounds in weight. His skin complexion is medium in
color. The individual is accused of an offense against the law of the State, namely
Possession of a substance, namely marijuana. You may arrest others for the same
offense who are unknown to the affiant but found to be occupants of said premises and
in control of same

AFFIDAVIT FOR SEARCH AND ARREST WARRANT

BEFORE ME, THE UNDERSIGNED AUTHORITY PERSONALLY APPEARED THE
AFFIANT HEREIN, A PEACE OFFICER UNDER THE LAWS OF TEXAS, WHO, BEING
DULY SWORN, ON OATH MADE THE FOLLOWING STATEMENTS AND
ACCUSATIONS:
My name is Officer Gerald Goines and | am commissioned as a peace officer by
The Houston Police Department.
1. There is in Houston, Harris County, Texas, a suspected place and premises
described and located as follows: a one story residence located in the "2807 Nettleton”.
The above location is located in Houston, Harris County, Texas. The residence is
constructed of wood which is white in color. The residence is located on the east side
of Nettleton street. The intersecting street is Tuam. The front door faces east and has
burglar bars attached to it. The numbers "2807" are plainly visible on the residence.
The residence next door (south) has the numbers "2811" plainly displayed. The above
residence in question is located in the 2800 block of Nettleton. The most common
address to the above location in question is "2807 Nettleton", Houston, Harris County,
Texas. Said suspected place, in addition to the foregoing description, also includes all
other buildings, structures, and places on said premises and within the curtilage, if said
premises.is a residence, that are found to be under the control of the suspected party
named-below and in, on, or around which said suspected party may reasonably reposit
or secrete property that is the object of the search requested herein.
2. Said suspected place is in the charge of and controlled by each of the
following named and/or described suspected parties (hereafter called “suspected party,”
whether one or more), to wit: a black male, who is known by the street name of "B". He
is approximately thirty (30) years of age, five feet eight inches (6'8") in height and one
hundred and eighty (180) pounds in weight. His skin complexion is medium in color.
This individual is accused of an offense against the law of the State, namely Possession
of a substance, namely marijuana. You may arrest others for the same offense who are
unknown to the affiant but found to be occupants of said premises and in control of
same.
3. It is the belief of affiant that said suspected party has possession of and is
concealing at said suspected place in violation of the laws of the State of Texas the
following property: a drug, controlled substance, immediate precursor, chemical
precursor, or other controlled substance property, including an apparatus or
paraphernalia kept, prepared, or manufactured in violation of the laws of this state, to
wit: marijuana.
.j jee 56 2874. Affiant has good reason to believe, does believe, and hereby charges and
accuses that on or about 10/23/2016 in Houston, Harris County, Texas, the suspected
party committed an offense against the laws of the State of Texas, to wit, Possession of
a substance, namely marijuana. On said date and at said place, the suspected parties
did then and there intentionally and knowingly possess a substance, believed and
referred to as marijuana.
5. Affiant has probable cause for said belief by reason of the following facts and
circumstances: On October 23, 2016, a narcotic investigation was being conducted at
“2807 Nettleton”, Houston, Harris County, Texas”. The above residence located at
“2807 Nettleton had been under investigation by officers of the narcotic division for four
(4) weeks. On this date (10/23/2016), Your Affiant was contacted by the below
confidential informant regarding the above location mentioned above. Your Affiant met
with the confidential informant to further this narcotic investigation which was being
conducted at the above location in question. The confidential informant was met at a
pre-determined location to assist officers of the narcotic division with this investigation.
The confidential informant was searched and found clear of any narcotics and or
paraphernalia. The confidential informant then advised officers that at the above
location, narcotics were still being sold and stored. The confidential informant informed
your Affiant that within the last twenty-four (24) hours, the confidential informant was at
the above location in question. The confidential informant observed a quantity of green
leafy substance referred to as “Dro” at the above mentioned location. The confidential
informant was provided U.S. currency by your Affiant for the purpose of buying narcotics
from the above location in question. The confidential informant went directly to the
location above and would return directly to your Affiant. Your Affiant was then be given
a quantity of green leafy substance by the confidential informant. The green leafy
substance was believed to be marijuana by sight and smell. The substance was
purchased from the location above and from the male known as ‘B", who is more fully
described above. The term “Dro” is a street slang for marijuana. Surveillance was
placed on the above location by narcotic officers. Officers observed unknown people
going to the location and leaving after a short period which is consisted of street
narcotic activities. The confidential informant did advised that additional green leafy
substance was observed at the above location in question for sell. The confidential
informant also observed the above male known as “B", to be in control of the substance,
referred to as “Dro’, at the residence.
The confidential informant did advised that a rifle was observed inside the
residence in question at the front door. The confidential informant did advise that the
weapon and narcotics were in the care, custody and control of the above male known
as "B",
The confidential informant has provided information and assistance to officers in
the past on at least ten (10) prior occasions which has lead to narcotic arrests and
seizures. The confidential informant has proved to be creditable and reliable on prior
occasions. Officers have made arrests and seized narcotics based on information and
assistance provided by the confidential informant in the past.
wr 56 2876. Affiant requests authorization to enter the suspected place and premises
without first knocking and announcing the presence and purpose of officers executing
the warrant sought herein. As probable cause to believe that such knocking and
announcing would be dangerous, futile, or would inhibit the effective investigation of the
offense described in this Affidavit, affiant submits that the following facts and
circumstances: the above male known as “B” and more fully described above was
observed at 2807 Nettleton, Houston, Harris County, Texas. A quantity of green leafy
substance believed to be marijuana by sight and smell was sold to a confidential
informant with additional quantity for sell. A weapon was observed at the location. Your
Affiant believe that the weapon is being kept at the same location where the narcotics
are being stored. Based on your Affiant's experience, that when weapons are used or
displayed at a narcotic transaction, it is there for the protection of the narcotics, and or
to buy time so that the narcotics may be destroyed.
Wherefore, affiant asks for issuance of a warrant that will authorize affiant and
other peace officers to search said suspected place and premises for the property
described above and seize same, and to arrest and search each suspected party
named and described herein and others unknown to affiant found to be occupants of
and in control of said premises.
