EXTRA JUDICIAL SETTLEMENT OF ESTATE WITH WAIVER

KNOW ALL MEN BY THESE PRESENTS: That

We, Heirs of ERNESTO OBIAS TAGLE, herein represented by her son, RUMANDITO V. OSEA, of
legal age, married to MARLENE OSEA, Filipino and resident of San Roque, Bato, Camarines Sur;
Heirs of DIOSCURO VARDE, herein represented by his daughter, LYDIA VARDE, of legal age,
single, Filipino and resident of San Juan, Bato, Camarines Sur; Heirs of PILAR VARDE POTIAN,
herein represented by her daughter, AIDA P. MAGISTRADO, of legal age, widow, Filipino and
resident of San Roque, Bato, Camarines Sur and Heirs of ESPERANZA VARDE REBULADO, herein
represented by the heirs of ENRICA R. SENDON, namely: FERNANDO R. SENDON, widower and
FRANCIA S. ALTAMERA married to FERNANDO P. ALTAMERA; all of legal age, Filipino and
residents of San Vicente Ogbon, Nabua, Camarines Sur do hereby declare and manifest, THAT;

WHEREAS, AGRIPINO VARDE died intestate on _______________________________ at


San Roque Bato, Camarines Sur, which is his residence at the time of his death, leaving an
instate estate, part of which is a parcel of land situated at San Roque. Bato, Camarines Sur,
Philippines, more particularly described as follows:

“A portion of a parcel of Agricultural Land designated as Lot No. 3966


prt, containing an area of 0.1440 ha., bounded on the NORTH by Prov’l
Road, on the EAST by Simon Landagan, on the SOUTH by Lot No. 3966
prt. And on the WEST by Primitivo Intia in the name of Ernesto Obias
Tagle under ARP No. 97-010-0271 with an assessed value of Php
1,560.00 effective 1998”

WHEREAS, the above-named decedent left to known debt or obligations which remain
unpaid and unsettled and chargeable against his estate;

WHEREAS, we are the heirs of the above-named decedent, entitled to and have the
right to succeed his estate, particularly the above-described property, by right of representation
to our respective parents, they being the legitimate children siblings of the decedent and we
are beings his grandchildren;

NOW THEREFORE, for and in consideration of the foregoing premises and invoking Sec.
1, Rule 74 of the Rules of Court, we do hereby adjudicate unto ourselves the above-described
property, subject only to contingent liabilities to creditors, heirs and other persons who might
have been deprived of lawful participation therein accordance with Sec. 4, Rule 74 of the Rules
of Court.

WAIVER

That we, the above named parties, except the Heirs of ENRICA R. SENDON, whose
names, juridical capacities and other personal circumstances are above-cited, for and in
consideration of our love and concern for the Heirs of ENRICA R. SENDON, their heirs and
assigns, and recognize them as the absolute owner thereof;

That the above-described property is a registered land and we, the parties here to agree
to record this instrument in the office of the Register of Deeds of the Province of Camarines Sur
under the provision of Sec. 113 of PD 1529, otherwise known as the Property Registration
Decree of the Philippines;

That the above-described property is not tenanted by any agricultural lessee hence not
subject to pre-emption under Sections 11 and 12 of R.A. 3844, otherwise known as the Land
Reform Code of the Philippines, nevertheless to Article 1623 of the Civil Code of the Philippines.

IN WITNESS WHEREOF, we have hereunto set our hands this ___ day of ___________
