Order no. 17  dated 22.07.2022:

Today   is   fixed   for   hearing   petition   u/s   151   CPC   filed   by   the   petitioners   on
10.01.2022   alleging   that   the   O.P   has   not   been   complying   with   the   court’s   order
allowing the petitioners to visit their minor grand daughter. 
The Ld. Advocates for both the parties are present. 
The   Ld.   Advocate   for   the   petitioners   submits   that   the   order   of   visitation   be
modified and the O.P be asked to bring the child in the court so that visitation can
take place under the supervision of the court. It is further submitted that the O.P
just brought the child for the purpose of visitation for ten minutes on one occasion
and on all other dates the O.P did not turn up at all with the child.
The Ld.  Advocate  for  the  O.P.  denied  these   allegations  and  submits  that   the
order of the court is being complied with.
Considered.
There   is   nothing   before   this   court   to   ascertain   the   actual   truth.   I   am   not
inclined   to   direct   that   the   visitation   shall   take   place   in   a   crowded   place   like   the
court.   It   is   not   an   appropriate   place   for   an   8­year   old   to   visit   on   regular   basis.
Further, it appears that both the parties reside at Parnasree. As such, the park at
Parnasree   which   has   been   decided   by   the   parties   would   be   ideal   for   visiting   the
minor child.
The petitioners are directed  that after each visitation , they would  provide the
O.P  in writing  the date, place and duration of such visit which would be proof of the
visitation. The O.P can also take photographs of visitation.
Hence, it is
ORDERED
that the instant application u/s 151 CPC is hereby disposed on contest without
costs in view of the above observation.
