MANDATORY COMPLIANCE INSTRUCTIONS N° 01/2022

  
REFERENCE: CONCLUSION OF WORK ACCORDING TO WORK CONTRACT
 
DATE : Cochabamba, July 26, 2022

All subcontracting companies, service and supply providers, or professional consultancies, without
exception, are informed that it is imperative the compliance of the objectives set. The latest date to
be presented is August 15, 2022. This is in accordance with the contractual obligations according to
the current schedule in the execution of the Cochabamba Metropolitan Train Project, with the
central level of the State (MOPSV ) that derive from the MOPSV No. 149/2017 turnkey work
contract, which have currently been made public to the population of Cochabamba.

From the foregoing, all subcontracting companies, service and supply providers, or professional
consultancies, without exception, are INSTRUCTED TO UNFAILINGLY COMPLY WITH THE
CONTRACTUALLY ESTABLISHED DEADLINES, with each one in particular, and simultaneously
it is also requested to consider that the conclusion of this work involves a series of activities
compliance which is mandatory, so all necessary provisions must be assumed.
andFurthermore all these are embodied in the contracts:

1. Carry out, on his own account and to the satisfaction of THE CONTRACTING PARTIES
(AAT), the final work tests of all the technical installations executed by them.
2. Once the work is finished, the surplus materials and means used in its execution will be
immediately removed, leaving the site that was occupied completely clean, and suitable for
the handing over.
3. They must be responsible for the accurate final management of the waste derived from their
activity, including the case of hazardous waste. Regarding the latter, they must be
delivered at the work site, as well as the documents that prove their withdrawal by approved
managers, adjusting to the current regulations in this regard.
4. In case of having completed the work and having observations by the CONTRACTING
PARTIES (AAT), through field notes, emails or notes, these must be corrected until August
15, 2022 at the latest.
5. Once the works are completed, they must reliably communicate their completion to the
CONTRACTORS (AAT), who will jointly schedule an inspection of them.

These contractual obligations and instructions set forth herein are the full responsibility of
the SUBCONTRACTORS and SUPPLIERS , so that in the event of non-compliance with the terms
framed in the contractual relationship, the corresponding penalties will be applied, without prejudice
to the activation of the actions for damages and losses that derives from its non-compliance.

From the foregoing, it is also important to remember that all companies expressly recognize
according to the contractual relationship that the object of each existing relationship derives from
the award of the Cochabamba Metropolitan Train Project, by the Tunari Accidental Association,
from this

part (AAT), the fulfillment of all our contractual obligations with the Bolivian State will be
guaranteed. Hence, if there are delays or breach of obligations by the SUBCONTRACTORS and
SUPPLIERS, or, where appropriate, determine a different action or one that contravenes the
indicated instructions, the TUNARI Accidental Association immediately, in addition to what is
indicated in the previous paragraph, will proceed and assume the pending works with its own
personnel or third parties, assuming the necessary costs that will inevitably be deducted from
pending payments with each one of their companies as appropriate of their contracted activities.

It is instructed to INDISPENSABLY comply with this Instruction, issued in coordination with the
Board of Directors.
