AGRICULTURAL TENANCY AGREEMENT

THIS AGREEMENT is made and executed at BARANGAY ADAMS, MUNICIPALITY OF ADAMS, PROVINCE
OF ILOCOS NORTE, ISLAND OF LUZON on the FIRST day JANUARY 2022

This Agricultural Tenancy Agreement, made and entered into by and between:

include the Landlord’s successors and assign’s) of the one part

(Hereinafter known as “AGRICULTURAL LESSEE” which expression together where the context so admits
shall include all persons having title under the Tenant) of the other part.

The AGRICULTURAL LESSOR agrees to rent out and the AGRICULTURAL LESSEE agrees to take the
Premises for a lease term commencing from the FIRST day of JANURARY 2022 and ending on the FIRST
day of JANUARY 2062 at the total Monthly rent of (Philippines Pesos) NINETY FIVE THOUSAND PESOS
(Php95,000.00). .

WITNESSETH:

The AGRICULTURAL LESSOR is owner of fee simple of an agricultural land situated at the in BARANGAY
ADAMS, MUNICIPALITY OF ADAMS, PROVINCE OF ILOCOS NORTE, ISLAND OF LUZON, which shall be
referred to as the “LAND”, covered and registered under Transfer Certificate of Tile No. 111-02086513
of the Registry of Deeds of BATAC, and more particularly described as follows:

“A parcel of land being a portion of the Consolidation Plan PSD - 67008 ,being a portion of Lot 6549,
Adams Estate LRC Rec. No. 9301, situated in the BARANGAY ADAMS, MUNICIPALITY OF ADAMS,
PROVINCE OF ILOCOS NORTE, ISLAND OF LUZON bounded on the SE, along Line 1-2 by Lot 4; on the SW,
along Line 2-3 by Lot 1; on the NW, along Lines 3-4-5 by Access Road, on the NE, along Line 5-6 by Lot 5;
and on the SE, along Line 6-1 by Lot 6, all of the Consolidation Plan; Beginning at Point 1 thence S. 14
Deg. 23’ W., 709M to Point 2, thence N. 75 Deg. 56’ W, 1,250M to Point 3; thence N.14 Deg. 19’ E, 655M
to Point 4, thence N. 15 Deg. 13 E’, 655M to Point 5; thence S. 74 Deg. 20’ E, 1,250M to Point 6; thence
S. 15 Deg. 16’ W., 566 to Point 1, containing an area of Eight Thousand Square Meters (8,000 SQM.),
more or less. All points referred to are indicated on the plan are marked on the ground by P.S. Cyl. Conc.

In consideration of the parcel of land, and of the mutual covenants and stipulations set forth, the
parties have agreed to the following terms and conditions:

1. That this Contract shall be governed by the provisions of Republic Act Nos. 6657, 3844 and other
related laws, rules and regulations issued by the Department of Agrarian Reform and shall strictly
conform to the conditional requirement embodied in Administrative Order No. 02, Series of 2006.

2. That this Contract shall bind both parties to fundamentally carry out the requirements necessitated
by agricultural leasehold relationship and other terms and conditions stipulated to maintain agricultural
production over a farm lot located in BARANGAY ADAMS, MUNICIPALITY OF ADAMS, PROVINCE OF
ILOCOS NORTE, ISLAND OF LUZON, owned and possessed by the AGRICULTURAL LESSOR and covered by
Transfer Certificate Title No. 111-02086513, Tax Declaration No. 8003, Plan No. 6, which landholding,
consisting of 12 hectares.

3. That this Contract shall commence and continue every agricultural year thereafter taking into
consideration the existing agricultural relationship of the parties until the same has been terminated or
modified in accordance with law and applicable provisions of Adm. Order No. 02, Series of 2006;

4. That this Contract upon approval by the DAR, decrees the leasehold rental for said landholding in the
amount of FIFTY THOUSAND PESOS (Php50,000);

5. That this Contract mandates that the AGRICULTURAL LESSEE shall pay the required lease rental which
shall not be more than the equivalent of 25% of the average normal net harvest based on the
computations made during the mediation/meeting conference as indicated in the attached Lease Rental
Worksheet (LAD-LHO Form No. 8), which forms an integral part of the Agreement;

6. That the AGRICULTURAL LESSEE or his/her duly authorized representative shall pay the leasehold
rental at BARANGAY ADAMS, ADAMS, ILOCOS NORTE, every month.

7. That this Contract sanctions the obligation of the AGRICULTURAL LESSEE to pay the lease rental due
of a particular agricultural year in spite of crop failure to the extent of seventy-five percent (75%) or
more than as a result of fortuitous event. However, such non-payment of the rental due shall not be
ground for the dispossession of the agricultural lease but the obligation to pay the said lease rental due
of that particular year is not extinguished.

8. That this Contract requires both parties to explicitly refrain from doing or committing prohibited acts,
such as:
8.1 That the AGRICULTURAL LESSEE shall not employ a sub-lessee on his/her landholding:
Provided, that in case of illness or temporary incapacity, he/she may employ laborers whose
services on his/her landholding shall be paid on his/her landholding shall be paid on his/her
account;

8.2 That it shall be unlawful for the AGRICULTURAL LESSEE TO mortgage/sell his/her leasehold
rights over the landholding;

8.3 That the AGRICULTURAL LESSEE shall not cause undue erosion of the soil or impair its
fertility;

8.4 That the AGRICULTURAL LESSOR shall not, without the AGRICULTURAL LESSEE’s written
consent, destroy crops and tress in the farmholding.

9. The agricultural leasehold relation between the parties shall not be extinguished by death or
permanent incapacity of the AGRICULTURAL LESSEE.

a. In case of death of permanent incapacity of the AGRICULTAL LESSEE, the person who can
cultivate the LAND personally, chosen by the AGRICULTURAL LESSOR within one month from
such death or permanent incapacity shall succeed as the new lessee, from among the following:
i. The surviving spouse;
ii. The eldest direct descendant by consanguinity; or
iii. The next eldest descendant or descendants in the order of their age: Provided, That in
case the death or permanent incapacity of the agricultural lessee occurs during the
agricultural year, such choice shall be exercised at the end of that agricultural year:
Provided, further, That in the event the agricultural lessor fails to exercise his choice
within the periods herein provided, the priority shall be in accordance with the order
herein established.
b. In case of death or permanent incapacity of the AGRICULTURAL LESSOR, the agricultural
leasehold contract shall bind his legal heirs.

10. The agricultural leasehold relation shall be extinguished only upon the following instances:
a. Abandonment of the LAND without the knowledge of the AGRICULTURAL LESSOR;
b. Voluntary surrender of the LAND by the AGRICULTURAL LESSEE, written notice of which shall be
served three months in advance; or
c. Absence of the persons to succeed to the lessee under paragraph 9 (a), in the event of death or
permanent incapacity of the lessee

11. In the event that the AGRICULTURAL LESSOR intends to sell or alienate the LAND, the
AGRICULTURAL LESSEE shall have a preferential right to purchase the LAND. A notice in writing shall be
sent to the AGRICULTURAL LESSEE containing the intent of the AGRICULTURAL LESSOR to sell the LAND
and a period of fifteen (15) days to exercise the preferential right to purchase.

12. In the event that the AGRICULTURAL LESSOR sells or alienates the LAND, the purchaser or transferee
shall be subrogated to the rights and obligations of the AGRICULTURAL LESSOR where the agricultural
leasehold relationship shall still remain in force.

13. That this Contract shall be deemed in total compliance with the policies and governing principles
embodied in existing laws and any future disagreements or violations committed by either party shall be
settled amicably through the mediation procedures laid down in the guideline;

14. That any change or modification of the terms and conditions of this agreement, or sale or transfer of
the land to another shall not in any way affect the right of the AGRICULTURAL LESSEE to the peaceful
submission and cultivation of the landholding;

15. That this Contract shall be registered with the Office of the Municipal Treasurer pursuant to DAR-
DOJ Memorandum Circular No. 1, Series of 1995 annotated at the back of the Certificate of Title on file
in the Register of Deeds Office.

IN WITNESS WHEREOF, the parties hereto signed this Agreement this BARANGAY ADAMS,
MUNICIPALITY OF ADAMS, PROVINCE OF ILOCOS NORTE, ISLAND OF LUZON, PHILIPPINES
