Sir, It has been brought to the notice of this office that seafarers (both Indian and foreign) serving on board ships calling at ports in India are not being permitted shore leave. 2, In this regard it may be noted that India is a party to the Maritime Labour Convention, 2006, with effect from 09.10.2015. Regulation 2.4 [para.2] and guideline 54.46 [seatarer in foreign port] of the said Convention mandates that those responsible in port and onboard ship shall facilitate shore leave seafarers as soon as possible after a ship's arrival in the given port. 3, This Directorate had issued several instructions, SOP and orders to deal with the OVID 19 pandemic on board Indian vessels including cruise vessels seafarers and vessels calling Indian ports. 4. In view of the significant deciine in the COVID 19 cases across the country, this bifice vide DGS Order 13 of 2022 dated 01.04.2022 (copy enclosed) has withdrawn all COVID 19 related directives and SOPs issued by the Directorate General of Shipping wth immediate effect. Denial of shore leave can be extremely detrimental to the mental well being of seafarers and may result in fatigue impacting the safe navigation of the vessel. 6 The Port Authorities/Maritime Boards are accordingly requested to report the present status of grant of shore leave to the seafarers in their respective jurisdictions. If shore leave is not being permitted for any reason then the reason for denial of shore leave may also be given. © The matter may be accorded utmost. priority and the report may be send latest by 22nd of July. 8. This issues with the approval of the Director General of Shipping and Additional Secretary to the Government of India. In view of the significant decline in the COVID 19 cases across the country, the Ministry of Home affairs has issued order no, 40-3/2020-DM-I (A) dated 25.02.2022 to implement risk assessment-based approach on the opening of economic activities. 3, Further, Ministry of Home Affairs has also issued DO letter 40-3/2020-DM-I (A) dated 72.03.2022 to all Chief Secretaries of States indicating that considering the overall improvement in the situation and preparedness of the Government to deal with the pandemic, the National Disaster Management Authority hes taken a decision that there may not be any farther need to invoke the provisions of the Disaster Management Act for COVID containment measures after 31.03.2022. 4. Inview of the foregoing, it has been decided that all COVID 19 related directives and SOPs issued by the Directorate General of Shipping is withdrawn with immediate effect. Further, all passengers above 12 years of age may continue to carry vaccination certificates or negative RTPCR report. Minimum facilities to isolate Coronavirus patients on board and their immediate evacuation may continue to be maintained. 5. Further, in view of the nature of the pandemic and possibilities of resurgence, all stakeholder are cautioned to remain vi tin the matter and implement appropriate measures proactively whenever required to prevent resurgence of the pandemic in accordance with MoHEW, Central/State Government directives. 6.
