This is the true-life story of a person named Daryl, he was a 14 years old male at that

time when the unimaginable thing happened to him. Here is the story of Daryl who was a

victim of Sexual Abuse. As he vividly said, it was bright sunny morning when Daryl was

about to go their store, he saw a familiar face riding a trike. It was his uncle’s friend,

coincidentally the trike driver stopped and ask where he was going so that he can drop off

Daryl on his way. Since they were going to the same destination. Immediately after, Daryl

got inside and rode his trike as he was confident that the person whom he was riding the trike

was his uncle’s friend.

Upon riding the trike, Daryl noticed that they were going to a different path other that

to their original destination. Daryl was astonished when this trike driver grabbed him in a

secluded place where no living person is around. He was stoned and couldn’t even scream for

help. He was afraid that he might be killed by the trike driver whom he gave his trust. He just

felt helpless while the trike driver did his thing with Daryl.

Right after the trike driver molested Daryl, he just took Daryl to their store as if he did

not do some filthy things to Daryl, as if he did not commit a crime to a child. When Daryl

arrived at their store, he was not himself. When his sister approached to him, his eyes was in

an ending horizon of tears. His sister felt that something was wrong, and he asked him what

happened. Daryl couldn’t answer his sister because he was threatened by the Trike driver that

we would kill his family if he’d squeal what happened between them. He couldn’t answer at

first, but he was comforted by his family that “everything will be okay” and “you can tell us

everything”. At that point, Daryl gained his strength and told them the truth. His family was

in anger, and they all went comforting their son.

At that very same day, they went to the police station and reported what happened to

their son Daryl. Upon the report, the police station hastily arrested the perpetrator for an
alleged Sexual Abuse. Daryl was also interviewed by the Women’s and Children’s Desk

officer to provide sufficient statements about what transpired during the crime. During the

hearing the lawyer of Daryl said that the sufficient statement that Daryl could still testify

without being physically present to read his statement in the court because his statements

were full of details and the judged approved his request.

After the court hearing, Daryl and his family decided to drop the case because he just

initiated to seek some compensation from the perpetrator of the crime instead of going to

court and do all the hearing sessions. Daryl and his family were civilly compensated with

money.

After two months of the incident Daryl tried to commit suicide as he was very

devastated on what happened in his life. Daryl is still receiving a psychiatric treatment from

the sexual abuse that happened to him.

As I have conducted my interview, I have observed that on Daryl’s case they had an

equal treatment of the perpetrator of the crime. Because Daryl was guided by the WCPD

along the way as well as the perpetrator. We all know that the Philippine criminal Justice

System’s focus is the perpetrator, but we do not see that the victim also is one of the

beneficiaries on the CJS because if the case is successful then the victim can also feel that

justice has been served. But in the case of Daryl, he did not opt to continue the case because

he was unstable because of the sexual abuse that happened to him. Even though he did not go

through the case, he was provided with adequate things that the government could offer to

him and his family. But we cannot persuade Daryl and his family to go through with the case

in court if they are not physically and mentally prepared with the circumstances that will

happen along the way. Based on the criminal procedure you cannot file the same case

because that will be against the double jeopardy law.
