Public document – issued by reason of office

Private document – executed by the parties; If it involves real property these cannot be registered but
they are already bound to the property

Notarized through Acknowledgement

If none, it is private document

Purpose of notarization – according to the Supreme Court, it is to convert from private to public and for
registration (public records) and to be accepted for purposes of transfer

- Presumption of regularity
- Inform the parties that they know what the document contains as it involves money and
property
- With this there is a boundary

TCT, OCT, free patent, – proof of ownership

Initial remedy when there is a problem with real properties

Compel the other party to execute a deed of sale

By Sending a demand letter informing them about the problem and to compel
him to perform and execute a deed of sale in his favor

Purpose is to decongest the case; find the easiest cheapest remedy

Contract to Sell – realty properties; installment; partial transfer of ownership; ownership still retains to
the vendor; the possession is the only given right to the vendee

Deed of Sale – complete transfer of ownership

Exception: If the transaction involves 500 pesos and/or real property it need not to be in writing. And if
it is considered as unenforceable
