These teachers have been pursuing the matter for long time which has not been resolved till the date. She has informed that the guidelines of UGC Regulation 2006 and UGC Regulation 2009 and the Gazette published by Gol on July 11, 2009 the minimum qualification for appointment and Careet Advancement Scheme of ‘Teachers in Social Work Colleges for the teachers who have acquired / completed MPhil prior to July 11, 2009 are exempted from NET Exam. Besides, they are considered eligible at UGC level teaching for all benefits and dues like CAS etc. even if they are appointed on any date during the period of 1 st January 1994 to 11 th July 2009. The date of eligibility is to be considered the date of acquired / having completed MPhil degree for benefit of CAS. These teachers are following the matter for long time with state government. In support of the demand these teachers have given reference of a letter dated March 28, 2022 issued by UGC clarifying that such teachers are entitled for Career Advancement Scheme (CAS) and all consequential benefits as per norms provided that those teachers have received exemption from NET on basis of MPhil / PhD. The sufferings of these teachers are unattended till the date, In view of the above, I would be pleased if your goodself pay personal attention to the matter and take action to address the matter safeguarding the interests of these 500 teachers from Social Work Colleges under light of the guidelines of UGC referring the above said dated letter. As per the UGC Regulation, 1991 regarding Minimum Qualifications for Appointment and Career Advancement of Teachers in Universities and Colleges, the Teachers acquired/having completed M.Phil. degree by 31 December, 1993 are Exempted from NET Examination and Considered Eligible for alll benefits due like CAS etc. 2. As per the UGC Regulation, 2000 (1S Amendment) regarding Minimum Qualifications for Appointment and Career Advancement of Teachers in Universities and Colleges, the Teachers acquired /having completed M.Phil. degree by 31 December,1993 are Exempted from NET Examination and Considered Eligible for all benefits due like CAS ete. But the Principal Secretary, Higher & Technical Education, State of Maharashtra, and Director, of Higher Education, State of Maharashtra, mis- interpreting the provisions of UGC Regulation (2% Amendment) 2006 and the provisions of UGC Regulation (34 Amendment) 2009 and the provisions Published in the Gazette Government of India, dated 11™ July, 2009 regarding Minimum Qualifications for Appointment and Career Advancement of Teachers in Universities and Colleges, and concluding that the Teachers who have acquired/completed M.Phil. degree between 147 June, 2006 to 11™ July, 2009 and appointed during the same period are only Exempted from NET Examination and not during the period of 1S January,1994 to 11™ July, 2009. In view of the above, we, the ‘Akil Bhartiya Rashtiya Shikshik Mahasang, New Delhi request you to kindly instruct / direct clear guidelines to the Chief Secretary, Government of Maharashtra, Principal Secretary, Higher & Technical Education, State of Maharashtra, that all teachers who have acquired/completed M.Phil. degree before 117 July, 2009 and appointed during the period of 1% January, 1994 to 11™ July, 2009 are Exempted from UGC-NET Examination. Also clearly instruct them to consider their eligibility from the date of acquired/completed M.Phil. degree for all benefits like CAS etc. in respect of the teachers appointed and completed M.Phil. degree during 1S" January, 1994 to 11™ July, 2009. wo ©. There are several favorable judgments directed by the Hon'ble High Court and Hon’ble Supreme Court of India, in respect of the teachers who have acquired / completed M.Phil. degree and appointed during the period of 18t January, 1994 to 11Th July, 2009, in which University Grants Commission was the main and first party as a respondent. All these judgments are given by the Hon'ble High Court and Hon'ble Supreme Court of India, on the basis of affidavit in reply submitted by the Universily Grants Commission tn response to the several petitions raised in respect of the teachers acquired/ completed M.Phil. degree and appointed during the period of 1St January, 1994 to 11Th July, 2009 considering them eligible from the date of acquired/ completed M.Phil. degree. 7. Sir, as per our previous follow-ups with Maharashtra state Government we were promised that as soon as UGC clarifies its stand on M.Phil qualified teachers we will release state GR as per directions issued by UGC. Attached letter from UGC, New Delhi clearly states that the Teachers who have acquired M.Phil qualification should be exempted from passing NET/SET exam_and should be given all the benefits from date of acquiring the qualification. Also clear instructions are passed on that the date of acquired/completed M.Phil. degree for benefit of CAS and other service benefits to teachers appointed before 14% June 2006 etc. This will benefit 1200 teachers from State of Maharashtra.
