1. End-Semester Examinations

1.1 Assessment Component

 For all Compulsory courses at JGLS, the end semester assessment


will be for fifty (50) marks, except continuous assessment courses
which will be for 100 marks.
 For all Elective courses at JGLS, the end semester assessment will be
for thirty (30) to fifty (50) marks.
 For all Compulsory courses of the LL.M. Programme, the end semester
assessment will be for thirty (30) marks.

1.2 Nature of End-Semester Assessment

 The End- Semester Exams for all courses- Compulsory/ Core and
Elective courses this semester, i.e., Spring 2022 will be take–home
examinations.
 The time duration for all Compulsory/ Core courses, except the
continuous assessment, will be 12 hours.
 The End Semester Exams will be conducted by the Exam Office as per
the schedule prepared and released by the Exam Office.
 For elective courses, faculty members are required to schedule their
examination and inform the Examinations Office. The deadline for
submission of answer scripts by the students for their elective courses
should be between 16th May 2022 to 20th May 2022. All the end-term
examinations of elective courses should be concluded during the last
teaching week only.
 There will be a common question paper for every course across all
sections.
 The end-semester examination cannot be a live examination, such as
a presentation, viva, quiz or a multiple choice-question paper.
 For core courses, research papers cannot be given as end-semester
assessment.
 The end-semester assessment cannot be a group project/ group
assessment for any course.
 The maximum word-limit for the entire assessment is up to 3000
words. For LL.M. students, the maximum word limit for the entire
assessment is up to 6000 words.
 In the case of LLM (Residential) specializations in Alternate Dispute
Resolution, Intellectual Property and Technology Law and Corporate
and Financial Law and Policy, the specialised compulsory courses will

be considered as a ‘Core’ course for the purpose of examinations and


will have a common question paper. These will be scheduled by the
Exam Office.
 In the case of other LLM (Residential) programmes, barring the
mandatory courses, all other courses will be considered as ‘elective’
courses for the purposes of examination and need not have a common
question paper.

1.3 UMS

 All question papers for end term examination will be released on the
UMS portal.
 All students, including LLM students, must make their end-term
submissions on UMS only. Hence, students are advised to note that
email submissions of end semester answer scripts will not be
accepted.
 It will be the individual student’s responsibility to upload the correct
file on UMS while making the final submission. A submission that has
been uploaded on UMS will be considered final and changes to the
same cannot be made on a later date.
 Only the answer scripts submitted on UMS will be sent for evaluation.
Those submissions which are in the draft and are not submitted will
not be sent for evaluation. Students must ensure that they have
submitted the same and are not kept in the draft.
 Sharing of the answer scripts by the students with each other is not
permissible until the results are declared. Students are responsible to
keep their answer scripts confidential and not share with any other
student before the declaration of results.
 Students are advised to follow all guidelines issued by the
Examinations Office on how to make submissions on UMS.

2. Grading

Grading Structure

JGLS follows a CGPA based grading system by which students are placed in
grade categories of ‘O’ Grade to ‘Fail’ Grade in descending order. JGLS also
awards ‘P’ Grade or ‘F’ Grade for courses which are offered as Pass/Fail
courses.

Based on the grades obtained, students’ Cumulative Grade Point Average


(CGPA) is calculated. CGPA is deemed to be an indicator of the overall
academic performance/standing of students. CGPA is also an indicator of
merit and is widely used by higher educational institutions for admissions
and by employers for recruitments. For these reasons students always strive
for higher CGPAs.

Since the hybrid mode of education has started after a gap of 2 years, in
order to ensure smooth transition, JGLS has decided to continue with the
following modes of grading:
A. For Spring 2022 the opt-in and opt-out model (either choose the CGPA
model or Pass grade) will be followed. The opt-in and opt-out will be
exercised subject-wise as was done in Fall 2021. Students will have to

inform about their chosen option to the Examinations Office as per the
deadline which will be set by them.
B. In order to the pass the course, the student is required to obtain a
minimum of 40% marks in internal and end-term component
cumulatively and a minimum of 30% marks in the end-semester
component separately. End-term component being a test of students’
overall knowledge in the subject, it is essential that one should obtain
minimum grades in that component. This criterion remains the same for
all core courses as well as elective courses.

3. Re-sit / Incomplete Grade / Improvement Examinations

3.1 Re-sit/ Repeat Examinations

Students who score less than forty (40) marks out of the total of hundred
(100) marks at the end of the semester (i.e., after adding the internal
assessment marks and the marks scored in the end- semester examination)
or score less than 30% in their end-semester examination, in any
Compulsory or Elective course, shall be declared ‘fail’ in that paper. A ‘fail’
shall also be declared for students who have not appeared in the end-
semester examination unless the student has been granted an ‘Incomplete’
grade in accordance with para 3.2 below, for extenuating circumstances.

Students will be given opportunities to appear in such courses through Re-


sit/Repeat Examinations. All Repeat Examinations shall be marked out of
one hundred (100) marks. A student’s marks in internal assessments will
become redundant and will not be included in final marks. Students must
obtain at least 40% marks in the paper to be declared pass in the Repeat
Examination.

A student who scores 40% marks or more after having appeared in a Re-sit
Examination, i.e. passes their Re-sit Examination, shall have ‘*’ notation for
that course in the transcript.

However, ‘*’ shall not be indicated in case of those students who have been
permitted by the Office of Academic Affairs to not appear in the end-
semester examination in order to participate in co-curricular activities such
as moot courts, conferences, seminars and exchange programs or if the
student has been granted an Incomplete grade on account of extenuating
medical or other circumstances in which case notation ‘I’ will be reflected in
the transcript and after the student appears in the course ‘I’ will be
removed.

Appearing in the immediately available Re-sit Examinations is compulsory


and not subject to the discretion of the student. In order to appear in a Re-
sit Examination, the student must submit an application to the
Examinations Office in the relevant form available with the Examinations
Office and pay the requisite fee prior to the examination or as per the
deadlines fixed by the Examination Office.

3.1.1 Re-sit Examinations for Core courses

For Core courses, the student will have multiple opportunities to appear in
re-sit examinations of a particular Core course. The first Re-sit Examination
will be offered in the same semester of the academic year following the year
in which the course was first offered. In the event students do not clear the
first Re-sit Examination, a second Re-sit Examination will be offered in the
same semester of the academic year following the year in which the first Re-
sit Examination was failed.
For example, a student who fails a Compulsory course in the Fall Semester of
their second year, will be offered an opportunity to appear for the Re-sit
examination of the same course in the Fall semester of their third year. If the
student fails to pass the course again in this Re-sit Examination, the student
will be offered the same opportunity in the Fall Semester of their fourth year.

3.1.2 Re-sit Examinations for Elective courses

For Elective Course, only one opportunity will be available to appear in a Re-
sit Examination. It will be provided only once in the year subsequent to the
year in which the elective was first offered.
For example, if the student fails an elective course that was offered during the
Fall semester of their third year, then the student will have an opportunity to
appear for its repeat/re-sit examination during the Fall semester of their
fourth year only. The student will not be provided with a similar opportunity
for appearing in the re-sit examination of the course during the Fall semester
of their fifth year.
For the students in a graduating situation may be given a chance before one
year for the courses offered in the final year. However, this will be a final
chance to clear the elective course.

In the event that a student wishes to not take the Re-sit Examination for an
elective course, they may choose not to submit any form or fees. In this
instance, the student will have foregone their opportunity to pass that
elective course and will have to make up their credits elsewhere.

Failure to pass the Re-sit Examination for an Elective course will result in
no credits being awarded for the course. Any student who fails to pass an
Elective course even after the Re-sit Examination may enrol in that elective
course again through the elective bidding process.

Students who decide to forego the opportunity of a Re-sit Examination in an


elective course or Fail in the elective course will still have that elective
subject appear on their transcript, until the date of the Re-sit Examination
passes and the results for that semester are declared, after which the
Examination Office will remove that elective from their transcript. In no
case, students will have the opportunity to drop an elective course in which
they have passed.

3.2 Incomplete Grade

In the event a student is unable to appear for an end-semester examination


due to medical or other extenuating circumstances, the student must inform
the Examinations Office, the Vice Dean (Examinations) and the JGLS Office
of Academic Affairs, within five working days from the date of the missed
examination. Such information must be accompanied by a medical
certificate or other documentary evidence supporting the claim of
extenuating circumstances. If the claim is found to be valid, the student
shall receive an ‘Incomplete’ grade, instead of a Fail Grade ‘F’, for the
examination. The ‘Incomplete’ grade signifies extenuating circumstances
which prevented a student from completing the coursework or examination.
The student shall have an opportunity to complete the course through a Re-
sit Examination; however, notation ‘*’ will not appear on the student’s
transcript. The incomplete grade will be awarded for the entire course and
not for a particular component of the assessment. Therefore, the student’s
score in the internal assessment will become redundant in case an
incomplete grade is awarded in any course.

Even after the Incomplete Grade is awarded, the student will have to fill the
re-sit form but will not have to pay the re-sit fee. This will not have any
adverse effect on the CGPA or the Scholarships, where the student is
entitled.

3.3 Improvement Examinations

The students are permitted to appear in an examination to improve upon


the score of the end- semester examination (of Core/Compulsory papers
only) conducted in the previous year by paying an additional fee for an
‘Improvement Examination’. This opportunity is not available for Elective

courses. Improvement examination fee will not be refunded if a student does


not appear in improvement examination after depositing the fee and
submitting the form. The score secured by the student in the improvement
examination will prevail over all previous scores in the examination of the
course in question. That score shall be considered in determining the final
grade of the student, irrespective of whether it is more or less than the
previous grade received. The final grade secured shall appear with an (‘Im’)
notation in the grade sheet of the student to indicate that the grade was
secured by the student by appearing in an Improvement Examination.
Students can appear for Improvement Examination only once, which will be
in the year subsequent to the one in which the Core course was first offered.

A student who scores less than 40% marks in a course after having
appeared in an Improvement Examination for that course shall receive a Fail
Grade ‘F’ in that course and would be required to appear in the Re-sit
Examination for that course in the next academic year. A maximum of one
Improvement Examination would be permitted per student per course. A
student can withdraw from the Improvement Examination, after applying;
but it must be intimated to the Examinations Office, the Vice Dean
(Examinations) and the JGLS Office of Academic Affairs before the release of
the question paper.

4. Evaluations and Re-evaluation

 Revision of marks will not be allowed after the declaration of results


unless there is a typo-graphical error. All such requests for revision of
marks will have to be approved by the Vice Dean (Examinations).
 The re-evaluation process will be followed as per JGU guidelines.

5. Unfair Means and Practices

Students are expected to adhere to the highest standards of honesty and


integrity during the examinations process. The University policy related to
the use of unfair means in examinations is set out. The policy on plagiarism
which has been followed for take-home end-term/ external examinations
will be followed for all end-term submissions. Submissions will be checked
for plagiarism by the course instructors (through software tools or other
means), and in case of the reflection of more than 25% in the similarity
report, the case will be referred to the Unfair Means Committee (UMC).
However, between the limit of 25% to 30%, the evaluator will have the
discretion to decide whether a case of unfair means should be made and
referred to the UMC. While referring a case to the UMC, evaluators should
attach the plagiarism report with comments, if any. For checking plagiarism,

the similarity report must be produced strictly in accordance with the


institutional guidelines, that is, all quotes, footnotes and small matches (of
upto 14 words) will be excluded in online settings. The faculty must also
ensure that the answer scripts are not saved in the repository to avoid
similarity check between the answers submitted by students.

Submissions will be also checked for collusion by the evaluator, wherever


applicable. Collusion means secret or illegal cooperation or conspiracy
between the examinees in order to mislead or deceive examiners,
representing each one’s attempt in the examination as honest. In case any
student is involved in collusion by offering or receiving any help from any
other student, it will amount to unfair means and the case will be referred to
the UMC for the same. In matters of peer-to-peer collusion, faculty’s detailed
comments/remarks would be of utmost importance.

Since end-term examinations are supposed to be entirely anonymous, if


students send their end-term submissions directly to faculty member(s) via
email, not only will those submissions be rejected, but they will also account
for a case of ‘unfair means’ owing to violation of anonymity.

Penalty: Only the UMC has the mandate to impose penalty for the end-
term/external component. However, for internal components, the final
decision on penalty lies with the faculty. In cases reported to the UMC, if the
percentage of plagiarism is 26% to 49%, the penalty will be deduction of
marks. If the percentage of plagiarism is 50% or above, Fail grade will be
given to the student in the course.
In cases of peer-to-peer collusion, the penalty will include cancellation of the
examination of all examinees involved in collusion. A confession by one or
more students involved in collusion will not absolve anyone else of their
guilt.

LL.M. Dissertation: As per UGC norms, if a dissertation has more than 10


percent plagiarism, then the following penalties will be imposed:
Level 1: 10% to 40% - Such student shall be asked to submit a revised
script within a stipulated time-period not exceeding 6 months.
Level 2: Similarities above 40% to 60% - Such student shall be
debarred from submitting a revised script for a period of one year.
Level 3: Similarities above 60% - Such student’s registration for that
programme shall be cancelled.

Exclusions: The similarity checks for plagiarism shall exclude the following:
I. All quoted work reproduced with all necessary permission and/or
attribution.

II. All references, bibliography, table of content, preface and


acknowledgements.
III. All generic terms, extracts from statutes and common words.

Note: While using a software to detect similarity, faculty shall exclude


common words or coincidental terms of up to fourteen (14) consecutive words.

Important Note: The Examination Office will not provide more than 3
reminders to the faculty member for any matter and thereafter the matter will
be escalated to the Academic Deans/Vice Deans.
