Moot Court and Trial Advocacy – Assessment Instructions

The Moot Court Component of this module is divided into two parts – the written skeleton
argument and the oral presentation. Students are required to select 1) whether they will pleading on
behalf of the claimants or respondents AND 2) whether they will be dealing with Issue 1 or Issue 2 of
the moot problem. This selection will be made available to the instructor through the submission of
your skeleton argument, which will specify the side and issue you are pleading.

Please find below the instructions for the written and oral components of the Moot court
assessment:

A. Written Skeleton

• The written skeleton document is a 2-page document which will provide the overview and
logical flow of the legal argument taken by the student. This document shall set out the key
assertions, which if proved, shall result in the issue being decided in favour of the party
represented by the student.
• Under each assertion, the student shall set out in 5-6 lines the legal arguments taken, the
legal provisions and case law relied upon, the relevant facts which support their argument
and a concluding line.
• Within one argument, students are expected to plead a maximum of 3 sub-issues
(assertions). There is no need to include any ancillary section such as table of contents, cover
page, bibliography, or list of dates. Simply setting out a skeleton summary of arguments as
required above will suffice.
• Font: Times New Roman Size 12; Line Spacing: 1.5 lines; Normal Margins.

B. Oral Rounds

• The oral pleadings shall take place as per the time slots set out below. Each student will be
making oral pleadings for a duration of 10 minutes. During these oral arguments, the
student shall plead the same stance as set out in the skeleton argument, and may use this
document as reference material for the pleading.
• The student may, as per the discretion of the adjudicator, be asked questions related to the
facts of the case or the legal arguments made.
• Students will be assessed on their command over the facts of the case, the logical soundness
of the legal arguments made, the manner of presentation, and courtroom etiquette.

The Trial Advocacy Component of the assessment is also divided into two parts. The first is the
Lecture Diary, instructions for which have been provided to the class previously. The second is the
viva, which shall immediately follow the moot court component of the assessment. This component
will essentially require students to answer questions based on the trial diary prepared. Students
would have access to the trial diaries prepared by them, however questions will test the processual
understanding of the students, as developed during the live sessions organised during the semester.
The viva will last between 5-7 minutes.

*The trial advocacy assessment would not be conducted for those students who have already
completed this section previously and have informed the course instructor of this.

*Each assessment will be conducted on the day allotted in the order set out. However all students are expected to attend
the entire class for the date their session is scheduled.

**All questions related to these instructions can be asked in the next class scheduled. Any administrative issues may be
flagged with the class representative who shall aggregate the issues and send them across by email.
